I. L. ASPHALT PAVING CO., a corporation, organized <br />and existing under and by virtue of the laws of the State of <br />Nebraska hereinafter known as the Grantor, for and in <br />consideration of the sum of FIFTY -EIGHT THOUSAND NINETY -SEVEN AND <br />NO 1100 DOLLARS ($58,097.00) in hand paid and other good and <br />valuable consideration does hereby grant and convey unto CENTRAL <br />PLATTE NATURAL RESOURCES DISTRICT, hereinafter known as the <br />Grantee, and to its successors and assigns, a perpetual and <br />assignable right and easement in the land described upon Exhibit <br />A, which is attached hereto and made a part hereof by this <br />reference, to construct, maintain, repair, operate and replace a <br />flood protection levee, reserving, however, to the Grantor, its <br />successors and assigns, all use of and rights and privileges in <br />the land as may be used without materially abridging the rights <br />of easement expressed herein or materially changing the levee <br />which Grantee will construct within the easement area; subject, <br />however, to existing easements for public roads and highways, <br />public utilities, railroads and pipelines, situated in Hall <br />County, and State of Nebraska, and upon the following terms and <br />conditions: <br />No part of Grantee's levee shall be more than one <br />thousand eight hundred seventy -nine (1,879) feet above <br />mean sea level and Grantee shall construct a concrete <br />box culvert under the gravel quarry access road shown <br />upon Sheet 1 of 3 of Olsson Associates Sheet No. 603 <br />dated November 28, 2001 from file F: \970174 \DWG \603 - <br />2001, which was drawn for Grantee, to allow surface <br />water to flow through the levee from west to east only <br />1 <br />
