r <br />TIMOTHY J. AITKEN, hereinafter referred to as the "Affiant ", being first duly <br />sworn, upon oath deposes and states: <br />1. Affiant is a registered land surveyor employed by Olsson Associates. <br />2. Olsson Associates was retained by Central Platte Natural Resources District <br />for the purpose of preparing legal descriptions in connection with land acquisitions it <br />intended to make for the Wood River Diversion Project. <br />3. Affiant was the registered land surveyor who executed the Surveyor's <br />Certificate to the recorded plat of Grand Island Farmstead Project Second Subdivision <br />filed of record on March 30, 1999 as Instrument No. 99- 103254. <br />4. On October 24, 2000 Warranty Deed filed in the Office of the Register of <br />Deeds of Hall County, Nebraska, as Instrument No. 200009048, contained the following <br />legal description: <br />A tract of land located in Section Thirty -Four (34), Township Eleven (11) <br />North, Range Nine (9) West, of the 6s P.M., Hall County, Nebraska, and <br />more particularly deserbed as: <br />Commencing at the Southeast Comer of the Northeast Quarter, (SE <br />Corner NE1/4) of Section Thirty -Four (34), said point also being the point <br />of beginning; thence on assumed bearing of 89 123'53" W along the <br />South line of Said NE1 /4 a distance of 51.04 feet; thence N 02'57'10" W <br />a distance of 84.31 feet; thence N 03 °36'52" E a distance of 110.16 feet; <br />thence N 02'49'11" W a distance of 140.24 feet; thence N 04 °08'03" E a <br />distance of 30.06 feet; thence S 89 °26'03" E on a line parallel to the South <br />line of said NE1 /4 a distance of 43.03 feet to a point on the East line of <br />said NE1 /4; thence S 01 °35'38" E along the East line of said NEI /4 a <br />Distance of 364.44 feet to the point of beginning.
