The GRANTEE, CITY OF WOOD RIVER, agrees that its employees, agents, and contractors and their employees shall not during the term of the Temporary or Permanent Easement, block, interfere with or restrict the public's ingress and egress to GRANTOR's property through the presently existing driveways at the same time. It being the intention of the both the GRANTOR and GRANTEE that GRANTOR shall retain for GRANTOR and GRANTOR's business invitees at least one (1) source of access from either of GRANTOR's presently existing driveways. Should the GRANTEE, CITY OF WOOD RIVER, violate this provision, it will be liable to GRANTOR for resultant damages. The CITY OF WOOD RIVER further consents to and agrees to the restoration of the surface of GRANTOR's property within the Easement area to its state prior to the granting of the Easement at the conclusion of the construction. Should there be any sinking or settling of the surface within the Easement area, the CITY will restore, repair and continue to restore the surface. 3. The Temporary Construction Easement shall be a tract of land 10' wide and is described as the Westerly 10' of Lot Fifteen (15), Brett's Addition, to the City of Wood River, Hall County, Nebraska. The Temporary Construction Easement for said tract is hereby granted and conveyed to the GRANTEE for and during the period of construction of a sanitary sewer, to expire no later than January 1, 2003.
