200201335 <br />possible thereafter to its original condition as it existed <br />immediately prior thereto. <br />2. The GRANTEE, CITY OF WOOD RIVER, agrees that its <br />employees, agents, and contractors and their employees shall not <br />during the term of the Temporary or Permanent Easement, block, <br />interfere with or restrict the public's ingress and egress to <br />GRANTOR's property through the presently existing driveways at the <br />same time. It being the intention of the both the GRANTOR and <br />GRANTEE that GRANTOR shall retain for GRANTOR and GRANTOR's <br />business invitees at least one (1) source of access from either of <br />GRANTOR's presently existing driveways. Should the GRANTEE, CITY <br />OF WOOD RIVER, violate this provision, it will be liable to GRANTOR <br />for resultant damages. <br />The CITY OF WOOD RIVER further consents to and agrees to the <br />restoration of the surface of GRANTOR's property within the <br />Easement area to its state prior to the granting of the Easement at <br />the conclusion of the construction. Should there be any sinking or <br />settling of the surface within the Easement area, the CITY will <br />restore, repair and continue to restore the surface. <br />3. The Temporary Construction Easement shall be a tract of <br />land 10' wide and is described as the Westerly 10' of Lot Fifteen <br />(15), Brett's Addition, to the City of Wood River, Hall County, <br />Nebraska.
