JAMES REITER and MAVIS REITER, Husband and Wife, herein called
<br />the "GRANTOR ", whether one or more, in consideration of SIX
<br />THOUSAND TWO HUNDRED FIFTY DOLLARS ($6,250.00), receipt of which is
<br />hereby acknowledged, hereby grants and conveys unto the CITY OF
<br />WOOD RIVER, NEBRASKA, A Municipal Corporation in Hall County,
<br />Nebraska, herein called the "GRANTEE ", a Permanent and Perpetual
<br />Easement and right -of -way for public utilities, and a Temporary
<br />Easement for construction as follows:
<br />1. A perpetual right -of -way and Easement to construct,
<br />operate, maintain, extend, repair, replace and remove sanitary
<br />sewer mains, manholes, surface markers and other appurtenances
<br />connected therewith upon, over, in and through a tract of land 20'
<br />in width, more particularly described as follows:
<br />A tract of land 20' wide, 10' either side of a center line
<br />parallel to and 20' East of the lot line between Lots Fourteen
<br />(14) and Fifteen (15), of Brett's Addition, to the City of
<br />Wood River, Hall County, Nebraska,
<br />together with the following rights, namely: unrestricted ingress
<br />and egress under and across such land for the purpose of exercising
<br />the rights herein granted and to clear and keep clear of trees,
<br />roots, brush and other obstructions from the surface of such tract,
<br />except obstructions provided for in the following paragraph. Any
<br />such utilities and appurtenances placed upon, over and under such
<br />tract of land shall remain the property of the GRANTEE and may be
<br />removed or replaced at any time.
<br />The GRANTOR and GRANTOR's successors and assigns hereby
<br />covenant that no building or structure shall be erected or
<br />permitted on said tract without obtaining the approval of the CITY
<br />OF WOOD RIVER, provided, that the GRANTOR reserves the right to
<br />place, construct and maintain grassed lawns, concrete driveways or
<br />parking lots, or other similar obstructions not including trees,
<br />bushes or hedges, or other undergrowth in the area of such
<br />Easement. If the maintenance, repair, operation, construction or
<br />replacement of such sanitary sewer main requires removal or
<br />displacement of grassed lawns, concrete driveways or parking lots,
<br />fences, poles or other such obstructions, not including trees,
<br />bushes, hedges or other undergrowth, the GRANTEE agrees to replace
<br />such items and restore the surface of such Easement as soon as
