200200095 <br />1. Maintenance. The parties agree to maintain the joint driveway improvements <br />in a usable, neat and uniform manner so that the overall appearance of said driveway is <br />that of one driveway. Each party will stand the expense of upkeep and replacement of <br />their respective driveways and if either party should create damage to the other's <br />driveway, the party causing the damage shall stand the expense of repairs. Each party <br />agrees not to obstruct or impede in the reasonable use of such driveway for the purpose <br />of ingress and egress to and from the respective properties. <br />2. fie.. Winkler and Roepke agree to maintain their respective one -half of the <br />common garage in good condition and repair at all times. Each party shall confer with the <br />other regarding painting, roofing and other repairs so as to make their respective portions <br />of the common garage compatible in appearance and structurally sound at all times. <br />Winkler shall be responsible for the cost of the maintenance of that part of the common <br />garage situated on Winkler's real estate and Roepke shall be responsible for the cost of <br />maintenance of that part of the common garage situated on Roepke's real estate. Neither <br />party shall structurally alter, demolish or remove their respective one -half of the common <br />garage without the consent of the other nor shall either party interfere with the other <br />party's rightful use of the garage. <br />3. Mutual Easements_ Winkler hereby grants to Roepke and Roepke hereby <br />grants to Winkler an easement for ingress and egress over so much of their respective <br />driveways and over so much of their respective portions of the common garage so as to <br />enable the other party to have access for parking in their respective garage and for <br />access for maintenance, repair, painting and roofing of each party's respective share of <br />the common garage. <br />4. Binding Effect. This Agreement shall run with the land and be binding upon <br />the parties hereto, their respective heirs, personal representatives and assigns. <br />IN WITNESS WHEREOF, the parties have executed this Agreement the day and <br />year first above written. <br />Doris L.
