Wieland, hereinafter referred to as "Wieland ", <br />enter into this Agreement. <br />WHEREAS, the Best's are the owners of certain real estate located at 1907 West <br />Stolley Park Road, Grand Island, Hall County, Nebraska, more particularly described as <br />follows: <br />Lot Two (2) in Block "A" in "Park -view Subdivision" located in the <br />Northeast Quarter (NE 1 /4) of Section Twenty -Nine and the Northwest <br />Quarter (NW 1 /4) of Section Twenty -eight (28), in Township Eleven (11) <br />North, Range Nine (9) West of the 6`h P.M. in Hall County, Nebraska, <br />except a certain tract of land more particularly described as follows: <br />Beginning at the Northwest corner of Lot 2, Block A, Parkview <br />Subdivision, said point also being at the junction of the East line of <br />Pioneer Boulevard and the South line of Stolley Park Road: thence <br />proceeding East along the South line of Stolley Park Road for a distance <br />of 4.5 feet; thence deflecting right in a southwesterly direction for a <br />distance of 6.02 feet; thence deflecting right in a northerly direction for a <br />distance of 4 feet to the point of beginning <br />AND <br />The West Eight (8) Feet of the South Eight (8) Feet of Lot One (1), in <br />Block A, in Parkview Subdivision, a part of the Wl /2NW1 /4 of Section <br />Twenty Eight (28) and the E1 /2NE1/4 of Section Twenty Nine (29) in <br />Township Eleven (11) North, Range Nine (9) West, in Hall County, <br />Nebraska <br />and <br />WHEREAS, Myrl Wieland is the sole owner of a parcel of land with <br />improvements, at 2019 Pioneer Boulevard, Grand Island, Hall County, Nebraska, more <br />particularly described as <br />Lot Three (3), in Block "A ", in Parkview Subdivision, in the City of <br />Grand Island, Hall County, Nebraska <br />and <br />WHEREAS, there is a lawsuit pending in the District Court of Hall County, <br />Nebraska, between the Best's and Wieland captioned as "Tom Best and Trudy Best, <br />husband and wife, Plaintiff's, v. Myrl L. Wieland, Defendant, Case No. CI990 -251, in <br />which the Best's are seeking injunctive relief, personal injury, damages to property <br />resulting from an alleged trespasses of Wieland and <br />It <br />
