Lindquist, a member of the <br />)[ <br />Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor ", pursuant to a power of sale <br />contained in that certain Deed of Trust recorded on April 22, 1999 as Instrument No. 99- 104145 of the <br />Mortgage Records in the office of the Register of Deeds of Hall County, Nebraska, and the Secretary of the <br />Department of Housing and Urban Development, hereinafter called "Grantee ": <br />WHEREAS, on January 30, 2003, Eric H. Lindquist, as Successor Trustee, executed a Notice of <br />Default pursuant to which notice was given to Elias Zamarripa Gallegos and Pamela S. Zamamipa, husband <br />and wife, Tmstors, under that certain Deed of Trust recorded on April 22, 1999 as Instrument No. 99- <br />104145 of the Mortgage Records in the office of the Register of Deeds of Hall County, Nebraska, covering <br />that certain premises described as: <br />A tract of land comprising all of Lots Ten (10) and Eleven (11), Block One (1), Dodd and <br />Marshall's Addition to the City of Wood River, Nebraska, and a part of the street right of <br />way lying East of and adjacent to said Lots Ten (10) and Eleven (11), said part of the street <br />right of way being more particularly described as follows: Beginning at the southeast <br />comer of said Lot Eleven 01); thence N 00 degrees 00 minutes 00 seconds East (Assumed <br />Bearing) along and upon the easterly line of said Lots Eleven (11) and Ten (10), a distance <br />of One Hundred Fifty (150.0) feet to the Northeast comer of said I.ot Ten (10); thence S 88 <br />degrees 16 minutes 51 seconds East, along and upon the easterly prolongation of the <br />northerly line of said Lot Ten (10), a distance of Ten and Ninety Five Hundredths (10.95) <br />feet; thence S 08 degrees 16 minutes 21 seconds East, a distance of One Hundred Fifty <br />Two and Sixteen Hundredths (152.16) feet to a point on the easterly prolongation of the <br />southerly line of said Lot Eleven (11); thence N 88 degrees 17 minutes 11 seconds West, <br />along and upon the easterly prolongation of the southerly line of said Lot Eleven (11), a <br />distance of Thirty Three (33.0) feet to the point of beginning, <br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting forth the <br />nature of such breach and of his election to sell or cause to be sold such property to satisfy the obligation. <br />Said Notice of Default was filed for record in the Office of the Register of Deeds of Hall County, Nebraska, <br />on February 3, 2003 as Instrument No. 200301301 of the Miscellaneous Records of said County. <br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice pursuant to <br />said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska. <br />Subsequent thereto, beginning on March 11, 2003, Grantor caused to be published in The Grand <br />Island Independent, a newspaper having a general circulation in Hall County, Nebraska, a Notice of <br />Trustee's Sale setting forth a description of the property to be sold and stating that the described property <br />would be sold at public auction to the highest bidder for cash or certified or cashier's check, at the lower <br />level lobby of the Hall county Courthouse, I91 & Locust Street, Grand Island, Hall County, Nebraska, at <br />10:00 a.m. on April 22, 2003. Publication of such notice was made for five consecutive weeks on March <br />11, 2003, March 18, 2003, March 25, 2003, April 1, 2003 and April 8, 2003, the last publication being at <br />least ten (10) days but not more than thirty (30) days prior to the date of sale. <br />A copy of such notice of the time and place of sale was thereafter mailed to all parties entitled to <br />notice pursuant to said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska. <br />Pursuant to said Notice of Trustee's Sale, John B. McDermott, attorney for Eno H. Lindquist, <br />Successor Trustee, did at the time and place mentioned in said Notice of Trustee's Sale, offer said property <br />JAS/252670.1 <br />
