200306145 <br />be automatically extended for successive periods of ten (10) years, unless changed or <br />modified by a vote of a majority of the then owners of the lots in said subdivision. <br />12. If any owner of any lot, or their heirs or assigns, shall violate any of the <br />restrictive covenants, restrictions and conditions herein set forth, it shall be lawful for any <br />other person or persons owning any real estate in said addition to prosecute such <br />proceedings at law or in equity against the person or persons violated or attempting to <br />violate any such covenants, etc., and to prevent them from so doing or to recover damages <br />for such violations. <br />13. If any of the restrictive covenants, restrictions or conditions herein set forth <br />are violated and declared void by a court of competent jurisdiction, the remaining restrictive <br />covenants, restrictions, and conditions shall not be affected but shall stay and remain in <br />full force and effect. <br />14. This Agreement and the faithful performance of the terms thereof shall be <br />binding upon the heirs, administrators, executors, assigns, grantees, and devisees of the <br />parties of this contract, and upon the purchaser or purchasers of any lot or lots in said <br />Timberline Subdivision in the City of Grand Island, Hall County, Nebraska. <br />HEHNSON, LLC <br />By J. <br />R ck S.
