200306145 <br />AGREEMENTS FOR RESTRICTIVE COVENANTS, RESTRICTIONS <br />AND CONDITIONS FOR TIMBERLINE SUBDIVISION <br />WHEREAS, Hehnson, LLC, is the owner of Lots One through Ten (1 -10) in <br />Timberline Subdivision, a subdivision located in Grand Island, Hall County, Nebraska. <br />WHEREAS, it is the desire of the aforesaid owner of said subdivision to improve <br />Timberline Subdivision bythe sale of lots and encouraging the construction of modern and <br />desirable dwelling houses. <br />NOW, THEREFORE, in consideration thereof, and of the mutual benefits to be <br />derived by the owners of said subdivision, and any purchaser or purchasers, their heirs, <br />administrators, executors and assigns, the owner stipulates and agrees that all lots in said <br />subdivision sold, transferred and conveyed, shall be and are subject to the following <br />protective covenants, restrictions and conditions, all of which shall run with the land, as <br />follows: <br />1. All lots in the subdivision shall be known and described as residential lots. <br />All lots and construction in the subdivision shall comply with the City of Grand Island and <br />Hall County building codes. No building or dwelling house shall be moved into said <br />subdivision and placed upon a lot. No pre- fabricated, modular or mobile home shall be <br />placed on a lot. No trailer, tent, garage, shack or other unsightly out - building shall be used <br />as a residence. No barns, chicken houses, house trailers, commercial work or sales <br />shops, or other buildings for the care and housing of fowl, rabbits or livestock shall be <br />placed, maintained or used on any lot, nor shall any fowl, rabbits or animals other than <br />household pets be kept upon any lot, and household pets shall not be kept, bred or <br />maintained for any commercial purpose. No noxious or offensive activity shall be permitted <br />on any lot nor shall there be anything done thereon which may become an annoyance or <br />nuisance to the neighborhood. <br />2. Lots in the subdivision may include single family townhouses and <br />condominiums. No basement houses or apartments may be built on any lot. No individual <br />dwelling consisting of one level shall be constructed with less than 1,000 square feet of <br />living area, not including the garage. No dwelling of a two -story design shall have less than <br />750 square feet of living area on the ground floor, not including the garage. No commercial <br />or business enterprises shall be conducted or operated in said addition. No lot or lots shall <br />be divided or split to create smaller building areas, but lots may be combined, or combined <br />and divided, to establish larger building areas. In the case of townhouses and <br />condominiums, lots may be divided so the owner may own the land under the townhouse <br />or condominium. The lots may be further divided to accommodate the construction of <br />townhouses and condominiums or single family homes. Each dwelling shall contain a <br />private garage for not less than one (1) or more than three (3) cars. <br />
