"Deed of Trust" is defined in the Preamble. 200305579 <br />"Default" means any condition or event which constitutes an Event of <br />Default or which with the giving of notice or lapse of time or both would, unless <br />cured or waived, become an Event of Default. <br />"Deposits" is defined in Granting Clause IX. <br />"Equipment" is defined in Granting Clause III. <br />"Event of Default" means an Event of Default as defined in the Credit <br />Agreement. <br />"Grantor" is defined in the Preamble. <br />"Hazardous Substance" is defined in Section 2.05. <br />"Impositions" is defined in Section 2.03. <br />"Improvements" is defined in Granting Clause II. <br />"Insurance Policies" means the insurance policies and coverages required <br />to be maintained by the Grantor with respect to the Property pursuant to the Credit <br />Agreement. <br />"Insurance Proceeds" means, at any time, all insurance proceeds or <br />payments to which the Grantor may be or become entitled by reason of any <br />Casualty under the Insurance Policies with respect to the Property plus (i) the <br />amounts of any deductibles under such Insurance Policies; (ii) if the Grantor fails <br />to maintain any of such Insurance Policies, the amounts which would have been <br />available with respect to such Casualty had the Grantor maintained such <br />Insurance Policies; and (iii) all insurance proceeds and payments to which the <br />Grantor may be or become entitled by reason of any Casualty under any other <br />insurance policies or coverages maintained by the Grantor with respect to the <br />Property. <br />"Insurance Requirements" is defined in Section 2.04. <br />"Interest Rate" means, for any day, the lesser of the Base Rate for such <br />day plus 2% or the maximum rate permitted by law. <br />"Issuing Bank" is defined in Recital A. <br />"Land" is defined in Granting Clause I. <br />"Lease" means any lease, tenancy, subtenancy, license, franchise, <br />concession or other occupancy agreement relating to the Property, together with <br />any guarantee of the obligations of the landlord or the tenant thereunder, or any <br />(NY) 04675/1 20/REALNEBRASKA/form.dot.NE.doc <br />12 <br />
