<br /> G.A6SIGNMENT OF LEASES. Upon I.ender's requcst,Bonower shall assign to Lender all leases of the
<br /> Property und all security dcposits made in connection with leases of the Property. Upon the assisnment. Leteder -
<br /> shall have the right ta modify,cxtend or terminute the existing leases and to execute new leases. in Lender's sole
<br /> discretion. As used in this parat;roph o, the word "lease"shall mean"sublease"if the Security Instrument is on
<br /> a leasehold.
<br /> H. ASSIGNNiENT OF RENTS; APPOINTIV�NT OF RECEIVER; GENDER IN POSSES3ION.
<br /> Bortower absolutety and utecondidonaliy assfgns and transfcrs to I.ender all the rents and�venues("Renta")of
<br /> the Prop:rty, regazdless og to whom the Rents of the Property are payable. Borrower authorizes Lender or
<br /> • Lender's agettts to coliect the Rents,end agm,es that each tenant of the Property shall pay the Rents to L,ender or
<br /> Lender's agents.However. l�orrower shall receive the Rents untii(i)Lender has given Borrower notice of defauit
<br /> pursuant to paragraph 21 af the Security Inshvment and(ii)Lender has given notIce to the tenant(s)that the Rents
<br /> are to 6e paId to I.ender or I.ender's ugent. This assi�nment of Rents constiwtes an absolute assjgnment and aot
<br /> an assjgnment for additIonal security only.
<br /> If Lender gives notice of 6reach to Bornower:(i)all Rents recelved by Borrower shall be held by Borrower
<br /> as t�vstee for the benefit of I.ender only. to be applied to the swns secured by the Security Instrument;(ii)Lender
<br /> shAll bc et�iitied to coilect atid receive all of the Rents of the Property;(!ii)Borrower agrees that each tenant of the
<br /> Property shall pay all Rents due and unpaId ta I.ender or Lender's agents upon Lender's written demand to the
<br /> tenant: (iv)unless applicable law pmvides otherwlse.all Rents collected by Lender or Lender's agents sdalt be
<br /> applied first to the costs of teking control of and managing tha Pmperty and collecting the Rents. including. but
<br /> not limited to, attomeys' fees. rereiver's fees, premiums on receiver's bonda, repair and maintenance casts,
<br /> insurance premiums, taxes. assessments and other charges on the Property. and then to the sums secured by the
<br /> Secudty Instrument;(v)I.ender. Lender's agents or any judicially ap}�ointed receiver shall be liable to accauat for
<br /> only those Rents actually received; and (vi) Y.ender shall be entiiled to have a receiver appointed to take
<br /> possession of and manage the Property and collect thc Rents and profits derive�l from the Property without any
<br /> showin�as to the inadequacy of the Pmperty as secudry.
<br /> if the Rents of the Property are not sufficierrc to cover the costs of taking contml of and managtag the
<br /> Property and of oallecting ehe Rents any funds expended by I.ender for such purposes shall become indebtedness
<br /> of Borrower to L.ender secured by the Security Instrument pursuant to Uniform Cavenant 7.
<br /> Borrower represents and wanants that Borrower has not executed any prior assignment of the Rents and has
<br /> uot and w111 not perform any act that would prevent I.ender from exercising its rigflts under this paragraph.
<br /> L,ender. or L.ender's ageats or a judicially appointed receiver, shatl not be required to enter upon, take
<br /> comrol of ar maiatain the Property before or tifter giving notice aF defavlt to Dorrower. However,Lender. or
<br /> Lender's agents or u judiciaEly appointed nceIver, may do so at any time when a default occurs. Any appiicacion
<br /> of Rents shall not cnre or wsiive any default or invalidate any other right or reraedy of Lender.This assignment of
<br /> Rents of the Property shall temiinate when all the sums secured by the Security Instniment ane paid in full.
<br /> i.C�t035-DEFAULT PROYISION.Borrower's default or breach under any note or agraement in which
<br /> l.ender has an interest shall be a breach under the Security Instrument and Lertder may invoke eay of the remedies
<br /> permitted by the Sacurity Inswment.
