200406501 <br />6. Grading. Each Lot Owner shall obtain prior approval from the Committee for the <br />proposed grading of each Lot to assure consistent grading throughout the property. Each Lot shall <br />be graded or sloped to prevent erosion and the flow of surface water upon adjoining lots. <br />7. General Restrictive Covenants. <br />(a) The construction or installation of all antennas or dishes to be erected or constructed <br />shall require approval from the Committee. <br />(b) No temporary structures or out buildings shall be constructed or remain on any Lot, <br />except during construction and shall be removed immediately upon completion of construction. <br />(c) Permanent signage shall be permitted for each Lot, but shall require the prior approval <br />of the Committee. Temporary or mobile signs are permitted during construction or for the sale of a <br />property, but are not otherwise permitted. <br />(d) Each Lot Owner shall construct and install a public sidewalk parallel to each street <br />which abuts the portion of the Lot or Lots owned by said Lot Owner. <br />(e) The construction of any fences shall not be commenced unless and until written <br />approval of the type and material of the fence is approved by the Committee. No chain link fencing <br />shall be allowed. <br />(f) No Lot may be utilized or maintained or used as a dumping ground for rubbish, <br />including but not limited to leaf and grass clippings. All waste, garbage and trash must be kept in <br />sanitary containers in an enclosed area and removed from such lot on a weekly basis. All Lots <br />shall be kept free of debris and weeds and shall be kept mowed. All garbage or trash containers <br />shall be within fenced areas at an appropriate location. <br />(g) Any initial construction of a building shall be completed within 18 months of the <br />commencement of said construction. In the event that construction has not been started within four <br />(4) years from the date title to a lot is transferred to a Lot Owner, Arlington or its successor shall <br />have the absolute right to repurchase the lot for the amount paid by the lot owner. Arlington or its <br />successor may exercise this option by sending written notice to the Lot Owner of said Lot. <br />(h) No noxious or offensive activity shall be conducted or permitted upon any lot nor any <br />activity which is or may be an annoyance or nuisance to adjoining Lot Owners or which endangers <br />the health or unreasonably disturbs the quiet of the occupants of the adjoining Lots. <br />(i) No recreational vehicle shall be parked on the streets and recreational vehicles shall not <br />be or parked upon any Lot for more than twenty -four (24) hours, except that this prohibition shall <br />not apply to any Lot upon which a motel or hotel is constructed. <br />0) An ambulatory surgery center shall not be constructed, erected, or moved onto any Lot. <br />Surgery of a kind and nature typically performed in an out - patient setting or at an ambulatory <br />surgery center or in a hospital shall not be performed on any Lot. Surgery typically performed with <br />the assistance of an anesthetic provider shall not be performed on any Lot. <br />8. Termination / Modification. The Covenants may be terminated or modified in writing <br />by the owners of three -fifths (3 /5ths) of the Lots on a one Lot one vote basis. HOWEVER, <br />termination or modification of the general restrictive covenant set forth in paragraph 7 0) shall also <br />require the written consent of the owner of the Grand Island Surgery Center located on Lot Nine <br />(9) Richmond Subdivision in the City of Grand Island, Hall County, Nebraska. <br />9. Duration. The Covenants shall be of perpetual duration and shall run with the land, <br />unless and until the Covenants are terminated or amended as provided in the preceding paragraph. <br />10. Severability. The invalidation of any one of the covenants or restrictions set forth <br />herein shall not affect the validity of the remaining covenants, all of which shall remain in full force <br />and effect. <br />
