20040650. <br />3. Submission of Plans. Prior to the construction of any building on any Lot, a set of <br />building plans shall be submitted by the Lot Owner to the Committee for approval. Said building <br />plans shall be signed and certified by the Lot Owner as the true and correct copy of the building <br />plans for the building to be constructed on such Lot and contain a statement that the Lot Owner will <br />submit to the Committee for written approval, any amendments, modifications or changes to such <br />building plans. Such building plans shall show the size, exterior material, design and plot plan for <br />the building to be constructed on such Lot and including fences, elevation and exterior lighting. No <br />construction of any building on any Lot shall be commenced unless and until written approval of <br />the building plans for such building has first been obtained from the Committee. Written approval <br />or disapproval of such building plan shall be given by the Committee within thirty (30) days from <br />and after receipt thereof by the Committee. Approval of such building plans shall not be <br />unreasonably withheld; provided, however, that the Committee shall have the sole and exclusive <br />right, in its sole discretion, to approve or reject any such building plans if in the opinion of the <br />Committee, either the style, size, material, or plot plan do not conform to the general standard and <br />character of the buildings constructed or to be constructed on other Lots located within the <br />Property. <br />4. Design and Construction Standards The minimum standards to be applied by the <br />Committee in the review of design and building plans for buildings and improvements to be <br />constructed upon the Property shall include the following: <br />(a) All parking lots shall be concrete. <br />(b) All buildings shall have white trim and a minimum of 65% red brick on all sides of the <br />building. <br />(c) If active solar panels are installed, they shall be flush with the roof or sidewall of the <br />building and shall not be located in any yard or upon accessory buildings. <br />(d) All exterior air conditioning systems shall be located in the side or rear yard and shall <br />be screened by landscape shrubbery or fencing. <br />(e) All buildings shall be one story in height, except a motel or hotel may be <br />constructed on Lot Six (6) with a maximum of three (3) stories. <br />(f) All buildings shall have asphalt shingles similar in color and style to the shingles on the <br />buildings constructed on adjacent Richmond Subdivision. <br />5. Landscape Plans. Prior to the start of construction of any portion of any Lot, a <br />landscape plan signed by the Lot Owner shall also be submitted to the Committee for approval. <br />Any landscape plan must include, at a minimum, the following: <br />(a) A landscape plan for the entire portion of such Lot from the front Lot line to the <br />building to be constructed on such Lot, including location of yard and location size and number of <br />trees and shrubbery. <br />(b) Provide for the installation of an underground sprinkler system prior to any seeding or <br />sodding of such Lot. <br />(c) Provide for the seeding or sodding of such Lot within 120 days of occupancy of the <br />building. <br />(d) No construction of any building on any Lot shall be commenced unless and until <br />written approval of the landscape plan has first been obtained from the Committee. Approval of <br />such landscape plan shall not be unreasonably withheld; provided, however, that the Committee <br />shall have the sole and exclusive right, in its description, to approve or reject any such landscape <br />plan, if, in its opinion, such landscape plan does not conform to the general standards and character <br />of landscape plans for other Lots located within the property. <br />
