Commercial operations on lots shall be permitted; however, no advertising <br />signs may be placed on property unless they are smaller than three feet x five feet and <br />remain unlit. <br />5. No sod, earth, sand, gravel or trees shall be removed to the injury of the <br />value or appearance of any lot, and no unused building material, junk or rubbish shall be <br />left exposed on any lot except during actual building operations. No sign of any kind <br />shall be displayed to the public view on any lot, except one sign of not more than five <br />square feet advertising the property for sale, or signs used by a builder to advertise the <br />property during the construction and sales period. <br />6. No worn out or discarded automobiles, machinery or parts thereof shall be <br />stored on any lot in the subdivision and no portion thereof shall be used for automobiles, <br />junk piles or the storage of any kind of junk or waste material. All motor vehicles stored <br />on the property must be kept within garages or outbuildings unless they are moved at <br />least weekly. No motor vehicles shall be parked on lawns. <br />7. Certain easements are established for the installation and maintenance of <br />utilities or other access. Such easements are clearly marked on the recorded plat of the <br />subdivision. No fences may be constructed on recorded easements. <br />8. Any driveways constructed on lots shall be paved with concrete or asphalt <br />or covered with appropriate aggregate. <br />9. All construction and buildings shall be so performed and will comply with <br />requirements of the building codes and ordinances of the City of Grand Island, Nebraska. <br />10. All buildings shall be placed back from the center of the front line of the <br />lot a minimum of forty (40) feet. <br />11. Any fences constructed on a lot within the subdivision must be properly <br />maintained. <br />12. Owners are encouraged to landscape their lots in an appropriate and <br />pleasing manner. The owner of each lot shall keep the vegetation and grass thereon cut <br />to a height less than twelve (12) inches prior to construction. Following the construction <br />of the primary residence, all vegetation must be kept to a height of not more than eight <br />(8) inches. <br />13. These covenants, restrictions and conditions are to run with the land and <br />shall be binding on all persons and all parties claiming ownership of the lots for a term of <br />thirty (30) years from the date this agreement is recorded after which time, it shall be <br />automatically extended for a successive period of ten (10) years. This agreement may be <br />amended or a variance granted, during the first thirty (30) year period by an instrument <br />signed by at least seventy (70 %) percent of the owners of the lots. <br />
