M <br />rn <br />nn <br />'� <br />= D <br />c <br />M cn <br />n <br />vCb <br />CA <br />c <br />n <br />Lot One (1) of Frauen Subdivision, and addition to the City of Grand <br />Island, <br />Hall County, <br />Nebraska <br />200406442 <br />AGREEMENT FOR <br />RESTRICTIVE COVENANTS, <br />RESTRICTIONS AND CONDITIONS FOR <br />"FRAUEN SUBDIVISION" <br />WHEREAS, the undersigned constitutes the owner of all the lots in "Frauen <br />Subdivision ", an addition in Hall County, Nebraska, as more specifically described in the <br />plat of said subdivision as the same as recorded in the office of the Register of Deeds of <br />Hall County, Nebraska; and, <br />WHEREAS, it is the desire of the aforesaid owner of the lots contained in said <br />subdivision to improve "Frauen Subdivision" by the sale of lots and encouraging the <br />construction of modern and desirable dwelling homes; <br />NOW, THEREFORE, in consideration thereof, and of the mutual benefits to be <br />derived by the owner of said lots within said subdivision, and any purchaser or <br />purchasers, their heirs, administrators, executors, and assigns, the owner stipulates and <br />agree that any and all lots in said subdivision sold, transferred and conveyed, shall be and <br />are subject to the following protective covenants, restrictions and conditions, all of which <br />shall run with the land as follows: <br />1. All dwelling units in the subdivision shall comply with the City of Grand <br />Island Building Code for AG occupancy. No apartment house, nor shall any basement <br />house be built on any lot. No structure shall be erected, altered, placed or permitted to <br />remain on any lot other than a dwelling, private garage for not less than two cars, and <br />other secondary buildings incidental to the use of the lot. There shall be no more than <br />three (3) outbuildings, including detached garages and only one such outbuilding may <br />exceed a total area of 750 square feet. All outbuildings shall be finished in a manner <br />complementary to the principal dwelling. <br />2. No building or dwelling unit shall be moved onto said subdivision and <br />placed upon a lot including, but not limited to, mobile homes and manufactured homes. <br />No trailer, tent, garage, shack or other unsightly outbuilding shall be used in said <br />subdivision as a dwelling at any time, nor shall any structure of a temporary character be <br />used as a residence. No fowl, hogs or animals other than household pets, a maximum of <br />three (3) cattle or three (3) cow /calf pairs or a maximum of two (2) horses shall be <br />maintained on any lot within the subdivision. <br />3. No dwelling of a single level nature shall be constructed with less than <br />1,700 square feet of living area not including the garage and basement; no dwelling of a <br />two story design shall have less than 1,200 square feet on the ground floor not including <br />the garage; and no dwelling of a tri -level design shall have less than an overall total of <br />2,500 square feet not including the garage.
