<br />This First Amendment to Construction Security Agreement, Deed of Trust,
<br />Assignment of Rents, andSecurity Agreement (the "First Amendment to Trust Deed ") is
<br />made this --� day of J �'^`� , 2004, by Walnut Housing, Ltd., a Nebraska limited
<br />partnership ( "Trustor ") for the benefit of Lincoln Federal Savings Bank, a federal savings
<br />bank ( "Trustee" and "Beneficiary").
<br />RECITALS
<br />A. Borrower executed and delivered to Lender the Construction Security Agreement,
<br />Deed of Trust, Assignment of Rents, and Security Agreement dated October 1,
<br />2003, which was filed against the Trust Estate with the Register of Deeds of Hall
<br />County, Nebraska, on October 3, 2003, as Instrument No. 02003 -13229 (the
<br />"Trust Deed ").
<br />B. The Trust Deed describes certain real property, among other collateral, located at
<br />approximately 5th and Elm Streets in Grand Island, Nebraska, and legally
<br />described as:
<br />(i) Lot One (1), Block Eight (8), Rollins Addition to the
<br />City of Grand Island, Hall County, Nebraska, together
<br />with the Northerly Half (N 1/2) of the vacated alley
<br />abutting on said lot on the south;
<br />(ii) Lot Ten (10), Block Eight (8), Rollins Addition to the
<br />City of Grand Island, Hall County, Nebraska, together
<br />with the Southerly Half (S 1/2) of the vacated alley
<br />abutting on said lot on the north;
<br />(iii) Fractional Lot Ten (10) in Fractional Block Eight (8),
<br />Rollins Addition to the City of Grand Island, Hall
<br />County, Nebraska;
<br />(iv) All that part of Cleburn Street (now vacated), lying
<br />between the North line of 5th Street and the South line
