200405794 <br />6. Certain easements are established for installation and maintenance of utilities, such <br />easements being clearly marked on the recorded plot of said subdivision. Service lines for individual <br />residences for all public utility services, which are available to a lot from an underground source, shall be kept <br />underground. Exposed aerials of any kind shall not be used. Satellite dishes are allowed, but they are not <br />to exceed 18" in diameter, they must not be visible from the street, and they must be attached to the primary <br />structure. No mercury or sodium vapor lights are allowed on any lot. Grand Island, Nebraska installed street <br />lighting is exempted from all lighting restrictions. <br />7. No campers, trailers, motor or mobile homes, boats, recreational vehicles or trucks larger <br />than a three - quarter (3/4) ton pickup truck shall be stored on any lot, driveway or on the street in front of or <br />on the side of any lot. No campers, trailers, motor or mobile homes, boats, recreational vehicles or trucks <br />shall be left parked on the streets overnight. <br />8. The owner of each lot shall keep the vegetation and grass thereon cut to a height less than <br />eight inches (8" ) prior to construction and shall keep the shrubs, vegetation and grass thereon cut to a <br />reasonable height after construction. <br />9. No fences, side, rear or front shall be constructed of barbed wire, woven wire or creosote <br />treated posts above ground or any unsightly material. <br />10. All lots shall have sidewalks; and the acceptance of a deed of conveyance by any purchaser <br />or purchasers of any lot or lots shall be construed as consent thereto. Such sidewalks will be constructed <br />when the home is built. <br />11. These restrictive covenants, restrictions and conditions are to run with the land and shall be <br />binding on all persons and all parties claiming ownership of said lots, until January 1, 2014, at which time said <br />restrictive covenants, restrictions and conditions shall be automatically extended for successive periods of ten <br />(10) years, unless changed or modified by a vote of a majority of the then owners of the lots in said <br />subdivision. <br />12. If any owner of any lot, or their heirs or assigns, shall violate any of the restrictive covenants, <br />restrictions and conditions herein set forth, it shall be lawful for any other person or persons owning any real <br />estate in said subdivision to prosecute such proceedings at law or in equity against the person or persons <br />violated or attempting to violate any such covenants, etc., and to prevent him from so doing or to recover <br />damages for such violations. <br />13. If any of the restrictive covenants, restrictions or conditions herein set forth are declared void <br />by a court of competent jurisdiction, the remaining restrictive covenants, restrictions and conditions shall not <br />be affected but shall stay and remain in full force and effect. <br />14.
