X n : '`> <br />'^ rn Roc - o -�� <br />m <br />O 9 <br />rr: <br />CD <br />CA <br />CD <br />r <br />to <br />x, <br />W <br />on <br />(\ D <br />Co <br />F + <br />CD <br />co <br />..� <br />Cn <br />AGREEMENTS FOR RESTRICTIVE COVENANTS, RESTRICTIONS <br />AND CONDITIONS FOR TIMBERLINE SECOND SUBDIVISION <br />C �_� <br />• S U <br />WHEREAS, Hehnson, LLC, is the owner of Lots One through Five (1 -5) in Timberline Second <br />Subdivision, a subdivision located in Grand Island, Hall County, Nebraska. <br />WHEREAS, it is the desire of the aforesaid owner of said subdivision to improve Timberline Second <br />Subdivision by the sale of lots and encouraging the construction of modern and desirable dwelling houses. <br />NOW, THEREFORE, in consideration thereof, and of the mutual benefits to be derived by the owners <br />of said subdivision, and any purchaser or purchasers, their heirs, administrators, executors and assigns, the <br />owner stipulates and agrees that all lots in said subdivision sold, transferred and conveyed, shall be and are <br />sub'ect to the following protective covenants, restrictions and conditions, all of which shall run with the land, <br />as 1Jollows: <br />1. All lots in the subdivision shall be known and described as residential lots. All lots and <br />construction in the subdivision shall comply with the City of Grand Island and Hall County building codes. No <br />building or dwelling house shall be moved into said subdivision and placed upon a lot. No pre- fabricated, <br />modular or mobile home shall be placed on a lot. No trailer, tent, garage, shack or other unsightly out - building <br />shall be used as a residence. No barns, chicken houses, house trailers, commercial work or sales shops, or <br />other buildings for the care and housing of fowl, rabbits or livestock shall be placed, maintained or used on <br />any lot, nor shall any fowl, rabbits or animals other than household pets be kept upon any lot, and household <br />pets shall not be kept, bred or maintained for any commercial purpose. No noxious or offensive activity shall <br />be permitted on any lot nor shall there be anything done thereon which may become an annoyance or <br />nuisance to the neighborhood. <br />2. Lots in the subdivision may include single family townhouses and condominiums. No <br />basement houses or apartments may be built on any lot. No individual dwelling consisting of one level shall <br />be constructed with less than 1,000 square feet of living area, not including the garage. No dwelling of a two - <br />story design shall have less than 750 square feet of living area on the ground floor, not including the garage. <br />No commercial or business enterprises shall be conducted or operated in said addition. No lot or lots shall <br />be divided or split to create smaller building areas, but lots may be combined, or combined and divided, to <br />establish larger building areas. In the case of townhouses and condominiums, lots may be divided so the <br />owner may own the land under the townhouse or condominium. The lots may be further divided to <br />accommodate the construction of townhouses and condominiums or single family homes. Each dwelling shall <br />contain a private garage for not less than one (1) nor more than three (3) cars. <br />3. Any out - building shall be of the same quality and materials of construction as the outside <br />finish and roof of the residential structure. No buildings shall be constructed of unsightly materials, boxes or <br />similar lumber, nor larger than 24' x 24'. <br />4. No sod, earth, sand, gravel or trees (with the exception of the clearing of the lot) shall be <br />removed to the injury of the value of or appearance of any lot, and no unused building material, junk or rubbish <br />shall be left exposed on any lot except during actual building operations. No sign of any kind shall be <br />displayed to the public view on any lot, except one sign of not more than five square feet advertising the <br />property for sale or rent, or signs used by a builder to advertise the property during the construction and sales <br />period, or signs used by the owner to advertise the subdivision. <br />5. No worn out or discarded automobiles, machinery or parts thereof shall be stored on any lot <br />in the addition, and no portion thereof shall be used for automobiles, junk piles or the storage of any kind of <br />junk or waste material. <br />
