The recitals in such deed of any matters or facts shall be <br /> conclusive proof of the truthfulness thereof. Any person including, with <br /> limitation, Trustor, Trustee or Beneficiary, may purchase at such sale and <br /> Trustor hereby covenant to warrant and defend the title of such purchaser <br /> or purchasers; <br /> (b) As may be permitted by law, after deducting all costs, fees and expenses <br /> of Trustee and of this trust Deed incurred in connection with any such <br /> default or sale or foreclosure, or all of them, including costs of evidence of <br /> title in connection with sale, as Trustee's fee, as provided by law, and any <br /> attorney's fees incuned by the Trustee, Trustee shall apply the proceeds of <br /> sale to payment of <br /> (i) All sums expended under the terms hereof not then repaid with <br /> accrued interest at the default rate provided in the Note, <br /> (ii) All other sums then secured hereby, and <br /> (iii) The remainder, if any, to the person or persons legally entitled <br /> thereto; <br /> (c) Trustee may in any manner provided by law postpone sale of all or any <br /> portion of the Property. <br /> 1 S. Remedies Not Exclusive. No remedy herein conferred upon or reserved to <br /> Trustee or Beneficiary is intended to be exclusive of any other remedy herein or <br /> permitted or provided by law, but each shall be cumulative and shall be in <br /> addition to every other remedy given hereunder or now or hereafter existing by <br /> law or in equity or by statute. Request for Notice. Trustor hereby requests a copy of any notice of default or of <br /> notice of sale hereunder be mailed to it at the address set forth in the first <br /> paragraph of this Trust Deed. <br /> 20. Notices. Whenever Beneficiary, Trustor, or Trustee shall desire to give or serve <br /> any notice, demand, request or other communication with respect to this Trust <br /> Deed, each such notice, demand, request or other communication shall be in <br /> writing and shall be effective only if the same is delivered by personal service or <br /> mailed by United States first class mail, postage prepaid, addressed to the address <br /> set forth in the beginning of this Trust Deed, or in any request for notice, or <br /> change of address given as provided by law. <br /> Notice shall be deemed delivered upon personal service or five days after deposit <br /> in the U.S. mail as described above. <br /> 21.
