<br />This instrument, made this . day of May, 2004, between Eric H. Lindquist, a member of
<br />the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor ", pursuant to a
<br />power of sale contained in that certain Deed of Trust recorded on November 21, 2002 as Instrument
<br />No. 2002 -12947 of the Mortgage Records in the office of the Register of Deeds of Hall County,
<br />Nebraska, and Deutsche Bank National Trust Company, as Trustee for Long Beach Mortgage Loan
<br />Trust 2003 -1, hereinafter called "Grantee ":
<br />WHEREAS, on February 12, 2004, Eric H. Lindquist, as Successor Trustee, executed a
<br />Notice of Default pursuant to which notice was given to Paddi A. Mack and Thomas Fieldgrove,
<br />wife and husband, Trustors, under that certain Deed of Trust recorded on November 21, 2002 as
<br />Instrument No. 2002 -12947 of the Mortgage Records in the office of the Register of Deeds of Hall
<br />County, Nebraska, covering that certain premises described as:
<br />Part of Lot Eight (8) of Norwood Subdivision of part of the West Half of the Northwest
<br />Quarter (W1 /2 NW 1/4) of Section Ten (10) in Township Eleven (11) North, Range Nine
<br />(9) West of the 6"' P.M., Hall County, Nebraska, more particularly described as follows:
<br />Commencing at a point One Hundred and Six (106) feet West of the Southeast Corner of
<br />Lot Eight (8) and running thence North, a distance of Two Hundred and Twenty -Six (226)
<br />feet; thence West a distance of Seventy -Six (76) feet; thence South a distance of Two
<br />Hundred Twenty -Six (226) feet to the South boundary line of said Lot Eight (8); thence
<br />running East along the South boundary line of said Lot Eight (8) a distance of Seventy -Six
<br />(76) feet to the point of beginning,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on February 17, 2004 as Instrument No. 2004 -01376 of the Miscellaneous
<br />Records of said County.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Subsequent thereto, beginning on March 26, 2004, Grantor caused to be published in the
<br />Grand Island Daily Independent, a newspaper having a general circulation in Hall County,
<br />Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and stating
<br />that the described property would be sold at public auction to the highest bidder for cash or certified
<br />or cashier's check, at the lower level lobby of the Hall County Courthouse, 1St & Locust Street,
<br />Grand Island, Hall County, Nebraska, at 10:00 a.m. on May 6, 2004. Publication of such notice
<br />was made for five consecutive weeks on March 26, 2004, April 2, 2004, April 9, 2004, April 16,
<br />2004 and April 23, 2004, the last publication being at least ten (10) days but not more than thirty
<br />(30) days prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76 -1008
<br />R.R.S. Nebraska.
