In addition, the following conditions shall apply_ <br />(A) All waste water shall be treated in accordance with City of Grand Island City <br />Code Chapter 30 — Sewers and Sewage Disposal, with the exception that this License <br />Agreement shall replace the required discharge permit, and pursuant to The Forrest <br />Group's proposal for an air sparging system and SVE system modification dated <br />November 20, 2003. <br />(B) Notification shall be provided to Ben Thayer at the City Wastewater <br />Treatment Plant (308 -385 -5430) prior to each discharge event. The discharge point shall <br />be at the manhole located southeast of the City Fleet Services building at 111 West North <br />Front Street. <br />(C) A copy of the laboratory analysis and the quantity of discharge shall be <br />submitted to Ben Thayer, City of Grand Island, Wastewater Division, PO Box 1968, <br />Grand Island, NE 68802, for each discharge event. The quantity of sodium chloride <br />(NaCL) in the wastewater shall not exceed 50,000 mg/L. <br />(D) The sewer use fees (based on current fees) for discharge of wastewater shall <br />be $5.90/100 gallons. The minimum fee is $6.49. <br />(E) Discharge frequency shall be no more than once each week for a total duration <br />of six (6) months from commencing discharge. The quantity per discharge event shall be <br />approximately fifty -two hundred fifty (5,250) gallons. The release of the wastewater shall <br />be monitored and maintained at a rate of 10.15 gallons per minute. <br />4. RESTORATION OF PROPERTY. If the construction or maintenance of the <br />improvement identified in Paragraph 1 above requires the excavation of earth, removal of hard <br />surfacing, grass, vegetation, landscaping, or any other disruption of the surface of the public <br />right-of-way or neighboring property, the Licensee shall restore the surface of the area to the <br />same condition as it existed intmediately prior to the Licensee's work in the area. <br />5. EFFECTIVE DATE. This License Agreement shall take effect on the date it is <br />executed by the Mayor of the City of Grand Island as dated below. It shall continue for an <br />indefinite term or until such time as it is terminated as provided hereafter. <br />6. TERMINATION. This License Agreement shall terminate upon one or more of <br />the following occurrences: <br />(a) The City can terminate this agreement at any time by providing written notice to <br />terminate to contractor in charge of this project, Brian Symons of The Forrester G1oup at <br />6501 E. Commerce, Suite 230, Kansas City, MO 64120. <br />.2- <br />
