ZWIEBEL, Husband and Wife; THE OVERLAND NATIONAL BANK OF GRAND ISLAND, A Banking Corporation, and NATIONAL BANK OF COMMERCE TRUST AND SAVINGS ASSOCIATION, now known as WELLS FARGO BANK NEBRASKA, N.A., Trustee. A permanent and perpetual easement and right -of -way to construct, operate, maintain, extend, replace, repair, and remove sidewalks and hike/bike paths along and upon the following described tract of real estate: The North Fourteen (14) feet of the South Forty (40) feet of Lot One (1), Saunders Subdivision, in the City of Grand Island, Hall County, Nebraska. The Condemner's rights shall include all rights necessary for the full and complete use, occupation and enjoyment of the easement herein granted, including the right to excavate and refill ditches, to remove trees, bushes, hedges, undergrowth, and other obstructions interfering with the location, construction, inspection, repair, replacement, removal and maintenance of such sidewalks and hike/bike paths; provided, if such construction or maintenance requires the removal of existing hard - surfacing or grassed lawns, the Condemner (individually, or through its contractor) agrees to restore the surface of the easement area not used for a sidewalk or hike/bike path as soon as possible to its conditions prior to said construction or maintenance work. The Condemner agrees that the Condemnees may continue to use the easement area herein granted for any use permitted by law that does not interfere with the operation and maintenance of the sidewalks and hike/bike paths constructed therein.
