HERMANSEN, Husband and Wife; and <br />THE EQUITABLE BUILDING AND LOAN ASSOCIATION OF GRAND ISLAND, <br />NEBRASKA, A Federal Savings Bank, EARL D. AHL.SCHWEDE, Trustee. <br />A permanent and perpetual easement and right -of -way to construct, operate, maintain, <br />extend, replace, repair, and remove sidewalks and hike/bike paths along and upon the following <br />described tract of real estate: <br />The North Fourteen (14) feet of the South Forty (40) feet of Lot One (1), Burris <br />Subdivision, in the City of Grand Island, Hall County, Nebraska. <br />The North Fourteen (14) feet of the South Forty (40) feet of Lot Two (2), Burris <br />Subdivision, in the City of Grand Island, Hall County, Nebraska. <br />The North Three Hundred Forty-two and Eighty-five One - hundredths (342.85) <br />feet of the East Fifteen (15) feet of Lot Two (2), Burris Subdivision, in the City of <br />Grand Island, Hall County, Nebraska. <br />The Condemner's rights shall include all rights necessary for the full and complete use, <br />occupation and enjoyment of the easement herein granted, including the right to excavate and <br />refill ditches, to remove trees, bushes, hedges, undergrowth, and other obstructions interfering <br />with the location, construction, inspection, repair, replacement, removal and maintenance of such <br />sidewalks and hike/bike paths; provided, if such construction or maintenance requires the <br />removal of existing hard- surfacing or grassed lawns, the Condemner (individually, or through its <br />contractor) agrees to restore the surface of the easement area not used for a sidewalk or hike/bike <br />path as soon as possible to its conditions prior to said construction or maintenance work. <br />The Condemner agrees that the Condemnees may continue to use the easement area herein <br />granted for any use permitted by law that does not interfere with the operation and maintenance <br />of the sidewalks and hike/bike paths constructed therein. <br />
