, <br /> � � i <br /> 99 10 � �75 <br /> (iv) On Parcels 22 through 26, having ten (10) parking stalls per <br /> 1,000 square feet of Floor Area used as office space; and <br /> (v) On all Parcels, meeting all applicable laws, rules or regulations <br /> (without a variance) governing or relating to parking accommodations. <br /> (aa) "Service Facilities": Loading docks, trash compactors and enclosures, <br /> bottle storage areas, exterior coolers, electrical and refrigeration facilities, and other similar <br /> service facilities. <br /> (bb) "Shopping Center": That certain real property located at the southeast <br /> corner of the interse�tion of 13`h Street and Highway 281 in the City of Grand Island, Hall <br /> , <br /> County, Nebraska, coniprised of Parcels 1 through 5 and 14 through 29, collectively, as shown <br /> on Exhibit "A" and liiure particularly described in Schedule I attached hereto. Neither Allen <br /> Drive, nor the areas sl�own on Exhibit "A" as Parcels 6 through 13, nor the areas shown on <br /> Exhibit "A" as "Detention Area," are within this definition of Shopping Center. <br /> 1.3 Parties. Allen is the Owner of Parcels 1 through 5 and 14 through 29. <br /> Albertson's is the lessee of Parcel2 under the Albertson's Lease. <br /> 2. BUILDING AND COMMON AREA DEVELOPMENT <br /> 2.1 Building Location. <br /> (a) Building Areas. All buildings and other structures (except those <br /> permitted in the Common Area pursuant to Section 2.2 below) shall be placed or constructed <br /> upon the Parcels only iii the Building Areas; provided, however, that canopies, eaves and roof <br /> overhangs (including columns or posts supporting the same), normal foundations, utility cabinets <br /> and meters, signs, and cloors for ingress and egress may project from the Building Area into the <br /> Common Area. All of the foregoing shall be constructed and maintained in accordance with all <br /> local, state and federal laws, rules and regulations applicable thereto. Buildings may be located <br /> (or relocated) anywhere within a Building Envelope, provided that the total Floor Area of all <br /> buildings constructed within a Building Envelope shall not exceed the square footage assigned to <br /> such Building Envelope as shown on Exhibit "A." Parcels 14 through 29 shall at all times be <br /> Self-Parked. <br /> (b) Construction Within Building Enveloae. Prior to the construction of <br /> any building or Comiuon Area improvements within a Building Envelope, the Owner of the <br /> applicable Parcel shall ubtain from the Consenting Owners prior written approval to the site plan <br /> for that portion of the Common Area located within the Building Envelope, in accordance with <br /> the procedures set forth in Section 2.5. <br /> (c) Undeveloued Building Area. All Building Areas on which buildings are <br /> not existing or under construction on the date the Owner of Parcel2 first opens its building for <br /> 5 <br />
