r� � 4 <br /> t ' <br /> 99 10 � 376 <br /> Area available to the Owner of Parcel2 to construct a shelter or enclosure which is <br /> architecturally compatible with the Tenant's Building for purposes of conducting seasonal sales <br /> only, but no such structure shall be deemed a "building" for purposes of calculating tlie pro rata <br /> share of Parcel2 for any purpose, or applying the Restrictions on Building Area square footage <br /> set forth in this Declaration. <br /> (t� "Building Envelope(s)": All those area(s) on each Parcel within the <br /> "Building Envelope Line(s)," as shown on Exhibit "A." <br /> (g) "CAMA": That certain Common Area Maintenance Agreement between <br /> the parties hereto which encumbers the Shopping Center and is recorded concurrently herewith. <br /> , <br /> (h) "Common Area": All of those areas in the Shopping Center which are <br /> not Building Area, together with those portions of the Building Area on each Parcel which are <br /> not from time to time actually covered by a building or other commercial structure or which <br /> cannot under the terms of this Declaration be used for buildings. Canopies which extend over <br /> the Common Area, together with any columns or posts supporting the same, shall be deemed to <br /> be a part of the building to which they are attached and not a part of the Common Area. <br /> (i) "Consenting Owners": <br /> (A) As to Parcels 1, 2, 3, 4, and 5, the Consenting Owners shall be the <br /> Owners of Parcels 2 through 5, and Allen. <br /> (B) As to Parcels 14 through 29, the Consenting Owners shall be the <br /> Owner of Parcel2 and Allen; provided that at such time as Allen is no longer a Consenting <br /> Owner pursuant to the provisions of Section 1.1(i)(C) below, the Consenting Owners shall be the <br /> Owners of Parcels 1 and 2. <br /> (C) Notwithstanding the foregoing, Allen shall be deemed a <br /> Consenting Owner only for so long as Allen is the continuous Owner of Parcels which together <br /> comprise at least 15,000 square feet of Building Area. <br /> (D) For purposes of determining who is the Owner of Parcel2 under <br /> this definition of"Consenting Owners," the parties agree that Albertson's shall be deemed to hold <br /> the rights of the Owner of Parcel2, including the status and rights of Consenting Owner, for so <br /> long as the Albertson's Lease is in effect (including extensions granted by its terms or agreed to <br /> by the pazties to the Albertson's Lease from time to time). <br /> (j) "Development Agreement": That certain Development Agreement <br /> between the parties hereto which encumbers the Shopping Center and is recorded concurrently <br /> herewith as an attachment to the Memorandum of the Albertson's Lease. <br /> (k) "Environmental Laws": The Comprehensive Environmental Response, <br /> Compensation and LiaUility Act of 1980, the Toxic Substances Control Act, the Clean Water <br /> 2 <br />
