200401724 <br />13. Risk of loss to the real estate shall be upon Seller until the time of closing and <br />thereafter shall be upon Buyer. Seller shall continue in force until closing all insurance <br />now in force on the real estate. In the event, that prior to closing, the house located <br />upon the real estate suffers casualty loss to such an extent that it cannot reasonably <br />be repaired and placed in substantially its present condition with the insurance <br />proceeds, then Buyer shall have the right, prior to closing, to cancel this Agreement <br />and the down payment, if any, will be returned to Buyer. <br />14. Seller and Buyer each agree that time is an essential element of this Agreement. <br />15. If either Seller or Buyer breaches this Agreement, then the non - breaching party shall <br />be entitled to all remedies available at law and in equity for the performance of this <br />Agreement or for damages. <br />16.
