Kivett, Attorney at Law duly licensed to practice in the State of Nebraska, <br />Trustee, in the exercise of the power of sale conferred upon him, does hereby execute and deliver this <br />indenture, <br />PIS II110IDi.Y. AII. a reEw <br />WHEREAS, for a valuable consideration on September 21, 2000, Frank S. Gonzalez and Anabell <br />Gonzalez, husband and wife, Trustors, executed and delivered their Deed of Trust to Michael F. Kivett, <br />as Trustee, and Associates Financial Services Company, Inc., a division of CitiFinancial, Inc. (MD), as <br />Beneficiary, conveying the real estate hereinafter described in trust, with power of sale, in accordance <br />with the terms and provisions set forth therein; that said Deed of Trust was thereafter recorded on <br />October 2, 2000 in the office of the Register of Deeds of Hall County, Nebraska as noted in Instrument <br />No. 200008168; and <br />WHEREAS, that on August 24, 2001, Associates Financial Services Company, Inc., a division of <br />CitiFinancial, Inc. (MD), Beneficiary upon the aforementioned Deed of Trust, appointed Michael F. <br />Kivett, Attorney at Law, as Successor Trustee, which Substitution of Trustee was recorded September <br />10, 2001, in Instrument No. 200109162, in the Register of Deeds of Hall County, Nebraska. A copy of <br />said Substitution of Trustee was served upon the prior Trustee, Jerry J. Milner, on or about September 5, <br />2001; and <br />WHEREAS, the Trustors having defaulted in the payment of the indebtedness secured thereby <br />and the Beneficiary having delivered to the Trustee a written declaration of default and having deposited <br />with the Trustee all promissory notes together with Notice of Default; and <br />WHEREAS, in compliance with Sec. 76 -1006, Statutes of Nebraska, on the 10th day of <br />September, 2001 the Trustee filed a Notice of Default in the office of the Register of Deeds of Hall <br />County, Nebraska, as noted in Instrument No. 200109163, which Notice fully complied with the <br />requirements of said statute; and <br />WHEREAS, in compliance with Sec. 76 -1008, Statutes of Nebraska, on the 14th day of <br />September, 2001 the Trustee mailed by certified mail, with postage prepaid, a copy of such Notice of <br />Default with the recording date shown thereon, addressed to the following interested parties, to -wit: <br />O <br />N <br />O <br />O <br />F—A <br />N <br />CD <br />O <br />co <br />C=_ <br />6r <br />co <br />a <br />Z <br />Fa'. <br />d <br />
