<br /> KNOW ALL MEN BY THESE PRESENTS:

<br /> THAT United Nebraska Bank is the Trustee under a Deed of Trust made and c�
<br /> entered into on or about March 31 , 1997, by and between C & C Homes, Inc., a
<br /> Nebraska corporation, Trustor, and United Nebraska Bank, Trustee, and the United
<br /> Nebraska Bank, Beneficiary. Said Deed of Trust was recorded in the Office of the
<br /> Register of Deeds of Hall County, Nebraska, on April 3, 1997, as Document No. 97-
<br /> 102429. Further, United Nebraska Bank is the Trustee under a Deed of Trust made
<br /> and entered into on or about October 7, 1997, by and between C & C Homes, Inc.,
<br /> a Nebraska corporation, Trustor, and United Nebraska Bank, Trustee and Beneficiary.
<br /> Said Deed of Trust was recorded on October 8, 1997, in the Office ofi the Register
<br /> of Deeds of Hall County, Nebraska, as Document No. 97-108378. Further, United
<br /> Nebraska Bank is the Trustee under a Deed of Trust made and entered into on or
<br /> about October 30, 1997, by and between C & C Homes, Inc., a Nebraska
<br /> corporation, Trustor, and United Nebraska Bank, Trustee and Beneficiary. Said Deed
<br /> of Trust was recorded in the Office of the Register of Deeds of Hall County,
<br /> Nebraska, on October 31 , 1997, as Document No. 97-109151 . United Nebraska
<br /> Bank, Grantor, in consideration of the sum of Eighteen Thousand Six Hundred Dollars
<br /> (518,600.00) and other good and valuable consideration received from UNITED
<br /> NEBRASKA BANK, does hereby grant, bargain, sell, convey, and confirm unto
<br /> UNITED NEBRASKA BANK, (hereafter Grantee), the following described real property
<br /> located in Grand Island, Hall County, Nebraska, to-wit:
<br /> Lot Six (6), Block Two (21, Ponderosa Lake Estates Third Subdivision, an
<br /> Addition to the City of Grand Island, Hall County, Nebraska.
<br /> TO HAVE AND TO HOLD the above-described premises, together with all
<br /> tenements, hereditaments, and appurtenances thereunto belonging, unto the Grantee
<br /> and to Grantee's successors and assigns forever. Grantor does hereby covenant with
<br /> Grantee and Grantee's successors and assigns:
<br /> 1 . That C & C Homes, Inc., a Nebraska corporation, failed to pay to Beneficiary
<br /> payments which were contractually due, and the Grantor, at the request of the
<br /> Beneficiary, elected to declare the entire unpaid principal balance, together
<br /> with interest thereon, at once immediately due and payable.
<br /> 2. That a Notice of Default, as required by §76-1006, was recorded by Grantor
<br /> on October 9, 1998, as Document No. 98-109951 , in the Office of the
<br /> Register of Deeds of Hall County, Nebraska. A copy of said Notice of Default
<br /> was thereafter mailed to all parties entitled to notice pursuant to said Deed of
<br /> Trust and in compliance with §76-1008, R.R.S. Neb.
<br /> 3. That the Trustor failed to cure the default referenced in the Notice of Default
<br /> within thirty (30) days after filing of the Notice of Default.
<br /> 4. That a Notice of Trustee's Sale of the time and place of the sale was thereafter
<br /> mailed to all parties entitled to notice pursuant to said Deed of Trust and in
<br /> compliance with §76-1008, R.R.S. Neb.
