The Parties of the First Part agree that neither RSKS, LLC, nor Rodney (Rod) Tiarks, Trustee of the Rodney Tiarks Trust, managing member of RSKS, LLC, nor any successor managing member, nor any of the parties who comprise the remaining members of RSKS, LLC will take or join any action to sell, transfer, gift or otherwise convey any interest in any or all of the parcels known as Grandpa's Place, and more particularly described in Exhibit "A" to the ROFR, without compliance with all terms of the ROFR, specifically including but not limited to the duty to provide "Notice of Intent to Sell" as set forth therein to Blaine (Casey) Packer. 4. The signatories to this Addendum Agreement may execute the same in multiple counterparts, all of which shall be deemed sufficient when properly signed and notarized, and which together shall comprise the whole of this Agreement. 5. Upon completion of execution of this Addendum to ROFR Agreement, the Hall County, Nebraska District Court Case No. CI24-562 shall be dismissed with prejudice and this Agreement shall be filed in the office of Register of Deeds of Hall County, Nebraska.
