Locust, Ste. 501 <br />Grand Island, NE 68801 <br />REGISTER OF DEEDS <br />%2 00 <br />EASEMENT AGREEMENT <br />THIS EASEMENT AGREEMENT made and entered into this -3 day of <br />3 , 2026, by and between Urban Island, LLC, a Nebraska limited liability <br />company ("Grantee") and Artisans' Alley, LLC, a Nebraska limited liability company <br />("Grantor"). <br />WHEREAS, Grantee is the owner of the property legally described as the Easterly Two- <br />thirds (E 2/3) of Lot Six (6) and the Westerly One-third (W 1/3) of Lot Seven (7) in Block Sixty- <br />six (66) in the Original Town, now City of Grand Island, Hall County, Nebraska ("Grantor's <br />Property"); and <br />WHEREAS, Grantor is the owner of the property legally described as Lot Five (5) and <br />the Westerly One-third (W 1/3) of Lot Six (6), in Block Sixty-six (66) in the Original Town, now <br />City of Grand Island, Hall County, Nebraska ("Grantee's Property"); and <br />WHEREAS, Grantee and Grantor wish to mutually utilize the Easement, as herein <br />defined for access and maintenance. <br />NOW, THEREFORE, in consideration of the mutual covenants and agreements of the <br />parties, it is agreed as follows: <br />1. Grantor hereby grants and conveys to Grantee a permanent easement upon <br />Grantor's Property for use for access and maintenance, legally described as: The East Fourteen <br />(E 14') Feet of the West One-third (W 1/3) of Lot Six (6), Block Sixty-six (66), Original Town, <br />now City of Grand Island, Hall County, Nebraska, said easement containing 1,849 square feet, <br />more or less (the "Easement"). <br />2. Grantee accepts the Easement in "as is" condition. The Easement shall include the <br />airspace located above the easement, for the purpose of constructing, installing and maintaining <br />improvements or equipment on the buildings adjacent to the Easement, which may extend over <br />the Easement, which shall include, but not be limited to ventilation and ductwork, HVAC <br />equipment, or similar building systems servicing Grantor's Property and Grantee's Property. <br />3. This Easement shall run with the land and shall be binding and inure to the benefit <br />and detriment of the parties to this agreement, their respective heirs, successors and assigns to <br />Grantors' Property and Grantee's Property. <br />4. Grantor and Grantee shall equally share the cost of the installation and <br />maintenance of control-pad/keypad style security access systems, to allow for coded access for <br />authorized third -parties on the two gates currently securing the ingress and egress points of the <br />Easement. <br />5. Grantor and Grantee shall be permitted to share access codes to said secured gate <br />with their respective tenants, guests or other invitees so the same may access the Easement for <br />ingress and egress purposes at all times. <br />
