<br />by the Mortgagors to the Mortgagee, and any and all additional or future advances or loans
<br />which may be made by the Mortgagee to the Mortgagors.
<br />6. That the Mortgagors agree to pay and discharge at maturity all taxes and
<br />assessments and all other charges and encumbrances which are, or shall hereafter be, or appear to
<br />be, a lien upon the mortgaged property, or any part thereof, and they will pay all interest or
<br />installments due on any prior encumbrance. And in default thereof, the Mortgagee may, without
<br />demand or notice, pay the same and the Mortgagee shall be the sole judge of the legality or
<br />validity of such taxes, assessments, charges or encumbrances and the amount necessary to be
<br />paid in the satisfaction or discharge thereof.
<br />7. That the Mortgagors will at all times keep the buildings and improvements, which
<br />are now or which shall hereafter be erected upon the mortgaged premises, insured against loss or
<br />damage by fire or other casualty in an amount at least equal to its replacement value in some
<br />reliable insurance company or companies, approved by the Mortgagee, and will deliver the
<br />policies therefor to the Mortgagee to be held by the Mortgagee as further security. In default of
<br />the Mortgagors to obtain such insurance, the Mortgagee may procure the same, not exceeding the
<br />amount aforesaid, and may pay and expend for premiums for such insurance such sums of
<br />money as the Mortgage shall deem necessary.
<br />8. That if there be more than one Mortgagor or Mortgagee in this Mortgage, all
<br />covenants, terms, promises and obligations set forth in the Mortgage or adopted by reference are
<br />agreed to be joint and several covenants, terms, conditions, promises and obligations of the
<br />Mortgagors thereto.
<br />9. Mortgagors shall keep the Property in compliance with any and all federal, state
<br />and local laws, ordinances and regulations relating to industrial hygiene or to environmental
<br />conditions on, under or about the Property, including, but not limited to, soil and groundwater
<br />conditions. Mortgagors shall not use, generate, manufacture, store or dispose of, on, under or
<br />about the Property, or transport to or from the Property any flammable explosives, radioactive
<br />materials, hazardous wastes, toxic substances or related materials, including, without limitation,
<br />any substances defined as or included in the definition of "hazardous substances", "hazardous
<br />wastes", "hazardous materials" or "toxic substances" under any applicable laws, ordinances or
<br />regulations (collectively referred to hereinafter as "Hazardous Materials"). Mortgagor hereby
<br />warrants and represents to Mortgagee that there are no Hazardous Materials on or under the
<br />Property. Mortgagors hereby agree to indemnify and hold harmless Mortgagee, its directors,
<br />officers, employees and agents, and any successors to Mortgagee's interest, from and against any
<br />and all claims, damages and liabilities arising in connection with the presence, use, storage,
<br />disposal or transport of any Hazardous Materials on, under, from or about the Property,
<br />including, without limitation, (a) all damages directly or indirectly arising out of the use,
<br />generation, storage or disposal of Hazardous Materials by Mortgagors or any prior owner or
<br />operator of the Property, and (b) all costs of any required or necessary repair, cleanup or
<br />detoxification and the preparation of any closure or other required plans, whether such action is
