2C2633' which period will not be less than thirty (30) days. If I cure my failure to comply and/or other default within the period provided my participation in DARP will not be terminated. If after my uncured default the Lender elects to terminate my participation in DARP the Lender will provide me with notice in writing which will state the reason and the date my participation in DARP was terminated (which date will also be the date the DARP Discount Rate or Enhanced DARP Rate is terminated and the interest rate is restored to the interest rate it would be without any DARP discount), the amount of the restored interest rate and monthly payment without the DARP discount, and any additional interest I owe. In addition, at any time I may elect to terminate my participation in DARP. if I decide to terminate my participation in DARP I will also lose the benefit of the DARP Discount Rate or Enhanced DARP Rate and the interest rate I am charged and my monthly payment will be restored to the same they would be as if my participation is terminated by the Lender. If I elect to terminate my participation in DARP the Lender or other person or party acting as a depository of accounts maintained under DARP may request that I sign an acknowledgment of termination of my participation in DARP which will include an acknowledgment of the termination of the DARP Discount Rate or Enhanced DARP Rate and the restoration of my interest rate and monthly payment. I agree to sign the acknowledgment if requested to do so. At the time I terminate my participation in DARP and deliver the written acknowledgement of termination, if requested by the Lender, I will also complete and provide all documentation and information required to establish automatic debit from an account at a depository other than Lender or one designated by the Lender. Upon my request or provided I comply with the requirements of DARP and cure any defaults of the Note and Security Instrument, or otherwise at the Lender's discretion, the Lender may allow me to resume participation in DARP, but the Lender shall not be obligated to do so. My participation ill DARP will only resume if the Lender agrees in writing. The Lender reserves the right to waive any requirements of DARP at any time so I may continue or resume my participation in DARP, but only for so long and at the level of participation the Lender determines, and any such waiver shall be at the sole discretion of the Lender and may be revoked and/or rescinded by the Lender at any time and for any reason or no reason whatsoever. 2. As a condition of my participation in DARP I agree I will open and maintain a checking account (the "DARP Account") with the Lender or other depository institution designated by the Lender. 1 understand that the DARP Account will be a free/no cost (other than overdraft and/or insufficient funds charges) checking account and will not pay interest. I acknowledge and agree that the Lender will place a hold on the DARP Account for a period of six (6) months and, notwithstanding any other documents or disclosures provided to me, 1 will not have access to the funds in the DARP Account during this period. 3. If I am participating at the DARP ACH Level, signified by my selection below, I agree that the Lender shall have the option to require that all payments on account of the Note and Security Instrument, including, without limitation, regular monthly payments of principal, interest and monthly Escrow Items will be made from the DARP Account. I agree that unless I am notified in writing by the Lender otherwise, the Lender is deemed to have required that all monthly payments on account of the Note and the Security Instrument be made from the DARP Account. I agree that I will maintain a balance in the DARP Account sufficient to make the payments required to be made on account of the Note and Security Instrument on the dates the payments are due, and through and including any scheduled debit date. I hereby pledge all amounts in the DARP Account as additional collateral security for the repayment of the indebtedness evidenced by the Note and secured by the Security Instrument and any other amounts I owe to the Lender. I agree that the Lender has the option, but not the obligation, to make withdrawals and debit the DARP Account or otherwise offset the DARP Account to pay any amounts I owe the Lender, including, without limitation, any amounts I owe pursuant to the Note and Security Instrument. I agree to complete, execute and deliver to the Lender, or Lender's designated depository all documents reasonably requested to establish and identify the DARP Account and facilitate the automatic debit from the DARP Account for the purpose of paying any amount I owe the Lender, including, without limitation, to pay regular monthly payments of principal, interest and Escrow Items. I agree and hereby authorize the Lender to complete any and all withdrawal authorizations, and provide any missing information or information needed to complete a withdrawal instrument, including, without limitation, the amount to be withdrawn and transferred and the identification of the transferee, and to complete any withdrawal to be made by the Lender in the exercise of the rights I have granted to Lender herein, without further or prior notice to me. I hereby grant and appoint to the Lender and its designated depository, a limited power -of -attorney, coupled with an interest, for the purpose of completing any such withdrawal and any documentation it deems necessary or advisable to fulfill the purposes and intentions of DARP and to exercise or enforce the rights I have granted to the Lender herein. I hereby acknowledge that if I am participating in the Lender's Cash to Close program (the "CTC Program") and its requirements, the DARP Account may also be used as the designated account for the CTC Program. If the DARP Account and the designated account for the CTC Program are the same account then the DARP Account shall also be subject to the terms and conditions of any agreements, including without limitation, any pledge agreement, I have made as a condition of my participation in the CTC Program, and I agree to maintain in the account the aggregate balance of the total of the minimum balance I am required to maintain separately under each the DARP and CTC Program for as long as I am participating in the respective programs.
