Without the prior written consent of all Lot owners: (i) no building or dwelling <br />shall be moved onto each Lot; and (ii) no pre-fab, modular, manufactured or <br />mobile home shall be placed on each Lot. <br />6. No trailer, tent, garage, shack or any other unsightly outbuilding shall be used as a <br />dwelling at any time, nor shall any structure of a temporary nature be used as a <br />residence. <br />7. No sign of any kind shall be erected, placed or displayed on a Lot to advertise or <br />promote any commercial activity or business. <br />8. No worn out or discarded automobiles, tires, machinery, or parts thereof, junk <br />piles, or any hazardous materials or chemicals shall be stored on a Lot. <br />9. One (1) single family residence may be constructed on each Lot. No group home <br />is permitted on a Lot. No multi -family dwellings, apartments, cooperatives, <br />condominiums or townhomes are permitted. Subject to City Code requirements <br />one (1) shop or detached outbuilding building is permitted for a barn and/or <br />personal use. <br />10. The Covenants shall run with the land and shall be binding on all persons and all <br />parties claiming ownership of each Lot their successors, assigns and grantees, <br />their heirs, devisees and personal representatives, until such time as amended, <br />terminated or released by ALL of the owners of ALL Lots and the Protected <br />Property. <br />11. If an owner of a Lot shall violate any of the Covenants, any owner of any other <br />Lot may enforce the Covenants and a violating party shall be responsible to pay <br />all legal fees and court costs incurred in any enforcement action. <br />12. If any of the Covenants herein set forth are declared void or unenforceable by a <br />court of competent jurisdiction, the remaining Covenants shall not be affected, but <br />shall stay and remain in full force and effect. <br />13. All construction of improvements, wells and septic systems on the Lots are <br />subject to the Subdivision Agreement, zoning, statutes, applicable rules and <br />regulations. <br />OWNERS OF LOT 1 : <br />ICHARD D.
