Rezac and Jacqueline <br />A. Rezac a/k/a Jacquelin A. Rezac, husband and wife, ("Rezacs") the owners of Lot One <br />(1) Rezac Second Subdivision, Hall County, Nebraska and Ronald J. Willis and Lori D. <br />Willis, Co -Trustees of the Ronald J & Lori D. Willis Trust, owners of Lots Two (2) and <br />Three (3), Rezac Second Subdivision, Hall County and JA & Associates, LLC, a <br />Nebraska limited liability company, the owner of Lot Four (4) Rezac Second <br />Subdivision, Hall County, Nebraska. <br />KNOWN ALL MEN BY THESE PRESENTS: <br />I. <br />DESCRIPTION OF LAND <br />The land SUBJECT to the Covenants is legally described as: <br />Lots Two (2), Three (3) and Four (4), Rezac Second Subdivision, Hall County, Nebraska <br />(the "Lot or Lots'). <br />The land BENEFITED by the Covenants is legally described as: <br />Lot One (1) Rezac Second Subdivision, Hall County, Nebraska (the "Protected <br />Property'). <br />II. <br />DECLARATION OF PURPOSE <br />The purposes of the Covenants are: (i) to restrict development and improvement of the Lots, and <br />(ii) to preserve and protect the Protected Property. <br />III. <br />COVENANTS AND RESTRICTIONS <br />The Lots shall be and is subject to the following covenants and restrictions: <br />1. THE COVENANTS DO NOT RESTRICT THE DEVELOPMENT OF THE <br />PROTECTED PROPERTY IN ANY MANNER WHILE OWNED BY REZACS <br />OR ONE OF THEM. THEREAFTER THE COVENANTS SHALL APPLY TO <br />LOT ONE (1). <br />2. Water shall not be discharged, pumped, channeled, directed or drained in any <br />manner to cause water to leave the boundaries of a Lot. <br />3. No Lot may be subdivided or split to create additional lots without the prior <br />written consent of the owners of all Lots, which written consent shall be recorded <br />with the Hall County Register of Deeds in order to be effective; Provided <br />however, a Lot, or part of a Lot, may be combined with an adjacent Lot or <br />adjacent property which is not in the Subdivision subject to these Covenants. <br />4. No tower structures of any nature, including but not limited to, cell phone, <br />shortwave radio, or wind power generation are permitted on each Lot. Solar <br />panels are permitted only if affixed to the roof of the building being serviced. <br />2 <br />
