2025O611Co <br />WHEREAS, the undersigned desire to amend the Declaration. <br />KNOW ALL MEN BY THESE PRESENTS: <br />1. Exhibit "A" is hereby amended and any reference to Exhibit "A" in the Declaration, or <br />any amendment thereto, shall refer to the Exhibit "A" attached hereto and incorporated herein by <br />this reference. <br />2. Section 4 of the Declaration is hereby amended to read as follows: <br />4. Boundaries. The boundaries of each unit, including the unit's identifying <br />number, together with the Commons Area, are shown on Exhibit "A" (plat and plan) to <br />this Third Amendment to the Declaration of City Centre Condominiums. The boundaries <br />are the unfinished surface of the outermost interior walls, fireplace openings, if any, up to <br />the flue in a closed position, the unfinished surface of the basement floor, the unfinished <br />surface of the ceiling immediately below the roof as indicated for each separate unit upon <br />the attached Exhibit "A", and the extension of those surfaces where the unit includes <br />unenclosed space. <br />3. Section 7 of the Declaration is hereby amended to read as follows: <br />7. Allocated Interests. The allocated interests have been established <br />based upon a formula utilizing the number of units in the condominium and it is <br />hereby declared that all such interests shall be allocated in the following manner: <br />(a) Voting. Each unit shall be entitled to one (1) vote in the <br />conduct of the condominium through the association <br />(b) Common Expense Liability. Each unit shall be responsible for <br />and shall be assessed for all common expenses incurred by the association, <br />based upon the square footage of each condominium unit as a percentage <br />of the total square footage of the total condominium, less commons area, <br />as follows: <br />Unit One (1) 47.8945% <br />Unit Two (2) 4.4159% <br />Unit Three (3) 24.7284% <br />Unit Four (4) 15.1123% <br />Unit Five (5) 7.8489% <br />(c) Fractional Interest in Common Elements. Each unit shall be <br />allocated an undivided interest in and to the common elements of the <br />condominium, based upon the square footage of each condominium unit <br />as a percentage of the total square footage of the total condominium, less <br />commons area, as follows: <br />Unit One (1) 47.8945% <br />Unit Two (2) 4.4159% <br />Unit Three (3) 24.7284% <br />Unit Four (4) 15.1123% <br />Unit Five (5) 7.8489% <br />Page 2 of 4 <br />
