WITNESSETH: WHEREAS, a DECLARATION OF CITY CENTRE CONDOMINIUMS (hereinafter referred to as "the Declaration") was filed in the Office of the Register of Deeds of Hall County, Nebraska, on December 5, 2018, as Instrument No. 201807839, which Declaration was recorded against the following described real estate, to -wit: Lots One (1), Two (2) and the Easterly two-thirds (2/3) of Lot Three (3), Block Sixty -Three (63), Original Town, now City of Grand Island, Hall County, Nebraska; WHEREAS, the Declaration was previously amended by an AMENDMENT TO DECLARATION OF CITY CENTRE CONDOMINIUMS filed in the Office of the Register of Deeds of Hall County, Nebraska on December 6, 2018, as Instrument No. 201807862, and a SECOND AMENDMENT TO DECLARATION OF CITY CENTRE CONDOMINIUMS filed in the Office of the Register of Deeds of Hall County, Nebraska on September 26, 2019 as Instrument No. 201905923; WHEREAS, Section 9. of the Declaration provides that: Units may be combined or divided and incorporated within the boundaries of one or more other units by the filing of a proper Amendment to the Declaration executed by the owners of the units then combined or divided, containing a corresponding adjustment of the allocated interests, without the necessity of further approval- from other existing unit owners, thereby increasing or decreasing the number of units, so long as the units so combined or divided shall otherwise remain subject to all other provisions of the Declaration of City Centre Condominiums and any amendments thereof approved in accordance with Section 38 of the Declaration; WHEREAS, Daniel C. Huenefeld and Linda K. Huenefeld (collectively "Huenefeld"), the owners of Unit One (1), desire to convey to Paramount Development, LLC ("Paramount"), the owner of Unit Three (3), a portion of Unit One (1), and Paramount desires to acquire a portion of Unit One (1) from Huenefeld; WHEREAS, in addition to the authority granted to the unit owners under Section 9. of the Declaration, the undersigned, constituting the owners of more than Sixty -Seven Percent (67%) of the units in City Centre Condominiums, have the power to amend the Declaration pursuant to Section 38. thereof; and Page 1 of 4
