Walsh <br />Smith, Johnson, Allen, <br />Connick & Hansen <br />104 N Wheeler Avenue <br />Grand Island NE 68801-6015 <br />F1ia 3 ' l 4W /OLD <br />REGIS T ER OF DEEDS <br />THIRD AMENDMENT TO DECLARATION OF CITY CENTRE CONDOMINIUMS <br />THIS THIRD AMENDMENT is made this '56 day of Oc1-4r' , 2025, by <br />the undersigned, being the owners of Units One (1), Two (2), Three (3), and Four (4) and the <br />Declarant as specified in the Declaration creating the condominium identified as CITY CENTRE <br />CONDOMINIUMS, (hereinafter referred to as "Declarant"). <br />WITNESSETH: <br />WHEREAS, a DECLARATION OF CITY CENTRE CONDOMINIUMS (hereinafter <br />referred to as "the Declaration") was filed in the Office of the Register of Deeds of Hall County, <br />Nebraska, on December 5, 2018, as Instrument No. 201807839, which Declaration was recorded <br />against the following described real estate, to -wit: <br />Lots One (1), Two (2) and the Easterly two-thirds (2/3) of Lot Three (3), Block <br />Sixty -Three (63), Original Town, now City of Grand Island, Hall County, <br />Nebraska; <br />WHEREAS, the Declaration was previously amended by an AMENDMENT TO <br />DECLARATION OF CITY CENTRE CONDOMINIUMS filed in the Office of the Register of <br />Deeds of Hall County, Nebraska on December 6, 2018, as Instrument No. 201807862, and a <br />SECOND AMENDMENT TO DECLARATION OF CITY CENTRE CONDOMINIUMS filed <br />in the Office of the Register of Deeds of Hall County, Nebraska on September 26, 2019 as <br />Instrument No. 201905923; <br />WHEREAS, Section 9. of the Declaration provides that: <br />Units may be combined or divided and incorporated within the boundaries of one <br />or more other units by the filing of a proper Amendment to the Declaration <br />executed by the owners of the units then combined or divided, containing a <br />corresponding adjustment of the allocated interests, without the necessity of <br />further approval- from other existing unit owners, thereby increasing or decreasing <br />the number of units, so long as the units so combined or divided shall otherwise <br />remain subject to all other provisions of the Declaration of City Centre <br />Condominiums and any amendments thereof approved in accordance with Section <br />38 of the Declaration; <br />WHEREAS, Daniel C. Huenefeld and Linda K. Huenefeld (collectively "Huenefeld"), <br />the owners of Unit One (1), desire to convey to Paramount Development, LLC ("Paramount"), <br />the owner of Unit Three (3), a portion of Unit One (1), and Paramount desires to acquire a <br />portion of Unit One (1) from Huenefeld; <br />WHEREAS, in addition to the authority granted to the unit owners under Section 9. of <br />the Declaration, the undersigned, constituting the owners of more than Sixty -Seven Percent <br />(67%) of the units in City Centre Condominiums, have the power to amend the Declaration <br />pursuant to Section 38. thereof; and <br />Page 1 of 4 <br />
