The maximum height for commercial buildings on Lots 5, 6, 7, 8, 9, 10, <br />and 11 of the Subdivision shall be not more than 80 feet above the center of U.S. Highway 281 at <br />the midpoint of each such Lot along U.S. Highway 281. The maximum building height for the <br />anticipated five -story hotel on Lot 12 of the Subdivision shall be limited to 80 feet above the <br />surface of the center of Outlot A at the midpoint of Lot 12 along Outlot A. <br />11. Residential Development Zone. Lots 13 and 14 of the Subdivision are <br />within a Residential Development zone (a planned district as defined in the City's zoning <br />ordinances). The maximum building height for the anticipated residential use on said Lots 13 and <br />14 shall be not more than 80 feet above the surface of the center of Outlot A at the midpoint of <br />Lots 13 and 14 along Outlot A. Development of said Lots 13 and 14 shall be limited to sitework, <br />grading, and utilities until such time as the developer submits and receives approval for further <br />development of said Lots 13 and 14 by amending the Residential Development zone. <br />12. Controlled Access. No access to the Subdivision shall be permitted from <br />the frontage on U.S. Highway 281 unless otherwise approved by the Nebraska Department Of <br />Transportation (NDOT). Access on 13th Street and Webb Road shall only be permitted at the <br />accesses approved in the Development Plan and shall be subject to final design approval by the <br />City's Director of Public Works. <br />13. Overland Drive. In the event that the portion of Overland Drive north of <br />Outlot A and connecting to State Street ("North Overland Drive") is proposed to be redeveloped <br />or replatted, the City will require the future developer thereof to plat North Overland Drive as an <br />outlot for public use in the same manner as Outlot A and/or dedicate the necessary right of way <br />for a future public street. <br />14.
