202503286 <br />the Landscaping Regulations of the City and plans as submitted to and approved by the City's <br />Building Department. <br />9. Easements. Any easements set forth on the plat of the Subdivision shall <br />run with the land and shall be kept free of obstructions. The Subdivider (as to the Lot(s) owned <br />by each party comprising the Subdivider) shall indemnify the City for all costs associated with <br />any removal or repair caused by any obstructions, inclusive of attorney fees and costs for <br />enforcing City's rights under any easement. Each such easement will include the duty to <br />maintain the surface of any easement area and keep it clear of any worthless vegetation or <br />nuisance by the Subdivider (as to the Lot(s) owned by each party comprising the Subdivider). <br />10. Commercial Development Zone. Lots 1 and 2 and 4-12 of the <br />Subdivision are within a Commercial Development zone (a planned district as defined in the <br />Grand Island Zoning Ordinance) and subject to a development plan, which development plan is <br />included as Exhibit B attached to the Subdivision Agreement for the Conestoga Mall Ninth <br />Subdivision (as may be amended, the "Development Plan"). A copy of the Development Plan is <br />also available from the Hall County Planning Department. No development other than that <br />approved pursuant to the Development Plan or a subsequent development plan as approved in <br />accordance with the City's then -current zoning ordinances shall be permitted. <br />No building(s) on Lots 1, 2 and 4-12 of the Subdivision shall be constructed <br />outside of the building envelopes set forth in the Development Plan, provided buildings do not <br />have to encompass all of the building envelope. Required parking may be constructed in the <br />building envelope and/or elsewhere in or upon the Subdivision, as approved by the City. <br />The maximum height for commercial buildings on Lots 1, 2 and 4 of the <br />Subdivision shall be not more than 40 feet above the center of 13th Street at the midpoint of the <br />4 <br />
