Based upon the parties' stipulation, the appraisers appointed in the above <br /> captioned action need not proceed to appraise the property sought to be condemned to <br /> ascertain and determine damages sustained by the Condemnee, the Board of Appraisers <br /> need not meet and the report of the Board of Appraisers need not be filed and served <br /> upon the Condemnee.This Journal Entry and Order shall be deemed a final order for <br /> purposes of the above captioned action. A true copy of this Journal Entry and Order shall <br /> be prepared and certified under the seal of my office and transmitted to the Register of <br /> Deeds of Hall County for recording in the same manner as a condemnation award. <br /> THEREFORE IT IS ORDERED ADJUGED AND DECREED, that the <br /> Condemner shall be granted the following perrnanent and temporary easements: <br /> a. a permanent easement in, over, under and upon the real estate <br /> below the elevation of 1,847.5 feet above sea level described in Exhibit A <br /> and Exhibit D for the purpose of directing, storing, and channeling <br /> drainage waters upon and across the easement area sought to be acquired; <br /> b. the Condemner shall pay the Condemnee damages of $25,000.00 <br /> for the real estate described in Exhibits A, B and C and $43,000.00 for the <br /> real estate described in EYhibit D. Upon payment by the Condemner, <br /> receipts shall be filed with the Court. <br /> 3 <br />
