Box 400 <br />Grand Island, NE 68802-0400 <br />AGREEMENT TO MODIFY COVENANTS, RESTRICTIONS, AND CONDITIONS OF <br />HARDER ESTATES SUBDIVISION <br />The undersigned, owners of all of the lots of Harder Estates Subdivision, Hall County, <br />Nebraska, hereby unanimously agree to a modification of the teams and conditions of the <br />covenants, restrictions, and conditions for Harder Subdivision filed of record as Instrument No. <br />0200501617 with the Register of Deeds of Hall County, Nebraska on February 25, 2005 <br />(hereafter "the covenants"). <br />The undersigned agree to modify the covenants as follows: <br />1. In the "Declaration of Purpose" of the covenants, it is stated as follows: <br />WHEREAS, Declarants desire to vide for the construction of a <br />planned residential area consisting of single family residences rock without limitation open <br />spaces and recreational facilities; <br />The undersigned do hereby agree to amend this recital in the "Declaration of Purpose" to <br />now read as follows: <br />WHEREAS, Declarants desire to provide for the construction of a planned <br />residential area consisting of single family residences and dupiexen including without limitation <br />open spaces and recreational facilities; <br />2. In Article II paragraph 20, the covenants state as follows: <br />No campers, trailers, motor or mobil homes, boats, recreational <br />vehicles, trucks larger than a three-quarter ton (3/4) pickup truck or farm machinery or <br />implements shall be stored on any lot outside, or the driveway, or ®n the street or road in front of <br />any lot, nor shall they be parked on the sheet or roadway overnight. The architectural committee <br />may give written permission to allow parking of vehicles outside, as well as require landscaping <br />to maintain the esthetic appearance of the area. <br />The undersigned agree that paragraph 5 of Article II shall row be amended to read as <br />follows: <br />5. BUILDING REQUIREMENTS. No dwelling structure, garage or other <br />incidental building shall be built with scrap lumber, or moved on to the site, excluding a new <br />modular home. The dwelling structure shall be considered compleue when at least one floor of <br />living space over the entire basement area is complete. Following re additional requirements: <br />A) Each dwelling shall have at least 1100 square feet of living space above <br />ground, which shall not include garage, breeze way or open or enclosed porches. <br />B) Each dwelling shall have a garage which will accommodate at least two cars. <br />All garages must be attached directly to the dwelling or connected thereto by a breeze way or <br />similar structure. <br />C) Each building shall have a minimum of 4-12 pitch roof. <br />D) All structures shall be in earth tone colors. I <br />E) All construction shall be completed within one year of the date commenced. <br />The undersigned agree that paragraph 20 of Article II shall now be amended to read as <br />follows: <br />20.
