202501042 <br />occupancy of more than one (1) family. Short term rentals or occupancies less than thirty (30) <br />continuous days are not permitted. Commercial or business enterprises are permitted on the <br />Property provided such business complies with applicable zoning requirements and does not <br />disturb other Owners or occupants. No Lot shall be divided or split to create smaller lots, but Lots <br />may be combined to establish a larger Lot. Developer reserves the right to include and or/ convey, <br />to the Association Additional Property, including but not limited to, Lots, outlots, clubhouse, <br />private streets, hike and bike trails, lakes, pools, parks, green spaces and additional amenities under <br />this Declaration upon written notice to the Association, <br />2. Garages and Outbuildings; Temporary Structures. All Dwellings Lots must include <br />an attached garage, which must accommodate at least two (2) cars. No four (4) car garage shall be <br />allowed unless the Architectural Committee approves the plan for appearance. The single <br />outbuilding per Lot shall be of the same quality and material construction as the outside finish and <br />roof of the residential structure and shall not exceed sixteen foot (16') sidewalls or two hundred <br />(200) square feet. No building shall be constructed of unsightly materials, boxes or similar lumber <br />like materials. No building or dwelling house shall be moved, placed or allowed to remain upon <br />a Lot. No trailer, tent, garage, shack or other unsightly outbuilding may be used as a Dwelling at <br />any time, nor shall any structure of a temporary character be used as a residence. No metal storage <br />sheds are permitted to be on any Lot. No manufactured housing, no chain link fences of any type <br />and no mercury or sodium vapor lights are allowed on any Lot. Vinyl siding is not permitted. The <br />exterior sidewalls shall by 2" x 6" construction and minimum nine foot (9') in height for the main <br />floor. Iron "see thru" fences are permitted not to exceed fifty four inches (54") in height. Grand <br />Island, Nebraska, city installed street lighting is exempted from all lighting restrictions. <br />3. Architectural Control. So long as Developer owns at least one (1) Lot, it shall <br />maintain architectural control and shall be the sole member of the Architectural Committee and <br />shall control the Neighborhood Design Code, attached hereto and incorporated by reference, which <br />Developer may amend from time to time. Developer retains the right to appoint additional parties <br />to the Architectural Committee and the right to voluntarily transfer control of the Committee to <br />the Association at any time in its discretion. Thereafter, the Board of Directors of the Association <br />shall have the responsibility for approving architectural plans, Neighborhood Design Code and <br />landscaping plans on the Lots and the responsibility for maintaining a uniform quality in <br />construction. In the event the Developer, Association Board, or its designated committee fails to <br />approve or disapprove any design and location within thirty (30) days following the submission of <br />the plans and specifications approval will not be required, and this paragraph will be deemed to <br />have been fully complied with. Approval by the Developer, Board of Directors or Architectural <br />Committee shall not relieve the contractor from obtaining a building permit from the proper <br />building department of Hall County or the City of Grand Island. Any additions to or modifications <br />of any existing home shall not be made until the plans and specifications showing the nature of the <br />addition or modification have been submitted to and approved by the Developer or Architectural <br />Committee as applicable, in writing. <br />4. Pets. No barns, chicken houses or other buildings for the care and housing of fowl, <br />rabbits or livestock shall be placed, maintained or used on any Lot, nor shall any fowl, rabbits or <br />livestock be kept upon any Lot.
