202501042 <br />13 "Developer Control Period" means the period commencing upon recording of this <br />Declaration and ending as provided in Section Article II, Section 3. <br />14. "Dwelling" shall mean any building or portion of a building upon a Lot designed <br />and intended for use and occupancy as a residence by a single family residence. All Dwellings <br />shall only be constructed by an approved contractor (a "Contractor") as defined in the Master <br />Agreement for Sale of Lots executed by Developer and Contractors as listed therein, as may be <br />amended from time to time. No Owner who is not a Contractor may construct a Dwelling upon a <br />Lot. <br />15. "Lake" shall mean Prairie Lake to be constructed by Developer. <br />16. "Lake Lot" shall mean a Lot abutting the Lake to be constructed on the Property. <br />Initially Lake Lots shall be Lots 6-22 inclusive. Additional Lake Lots may be added to this <br />Declaration by Developer as Additional Property. <br />17. "Lot" shall mean any lot in the Property. <br />18. "Member" shall mean an Owner of a Lot in the Property. All Owners are Class A <br />Members. <br />19. "Non -Lake Lot" shall mean a Lot that does not abut the Lake to be constructed on <br />the Property. Initially Non -Lake Lots are Lots 1-5 inclusive. Additional Non -Lake Lots may be <br />added to this Declaration by Developer as Additional Property. <br />20. "Prairie District Homeowners Association Rules and Regulations" shall mean the <br />rules and regulations of the Association. <br />21. "Owner" shall mean the record owner, whether one or more persons or entities of <br />a fee simple title to any Lot. Initially, Developer is the sole Owner. An Owner may include a <br />person or persons or entities under a recorded land contract or installment sale contract if the record <br />owner executed a release and transfer of his or her voting rights to the contract purchaser. Others <br />having a lien or interest merely as security for the performance of an obligation are not owners. <br />22. "Property" means the Property included in this Declaration and any Additional <br />Property which may be included in Developer's discretion at any time. <br />ARTICLE II. <br />COVENANTS, RESTRICTIONS AND CONDITIONS <br />In consideration of the mutual benefits to be derived by the Owners and any purchaser or <br />purchasers, their heirs, devisees, personal representatives and assigns, all of the Lots in the <br />Property as surveyed and platted and more particularly described as recorded in the office of the <br />Register of Deeds, Hall County, Nebraska, that are sold, transferred and conveyed, shall be and <br />are subject to the following protective covenants, restrictions and conditions. All covenants, <br />restrictions and conditions shall run with the land and are as follows: <br />1. Lots Affected, Use of Lots. All Lots shall be single family residential lots. No <br />duplex, apartment house, or other multi -family structure shall be built on any Lot. No basement <br />house shall be built on any Lot. No structure shall be erected, altered, placed or permitted to remain <br />on any Lot other than one (1) Dwelling with an attached garage and one (1) outbuilding, which <br />must be complimentary to the design of the house and be within city setback limits. No Dwelling <br />shall be erected for occupancy of more than one (1) family, nor shall any Dwelling be used for <br />3 <br />
