<br />ARTICLE 12
<br />RESTRICTIVE COVENANTS AND OBLIGATIONS.
<br />1) Alterations. After completion of the initial buildout of each condominium unit, no
<br />Unit Owner shall make any structural addition, alteration or improvement in or to
<br />a Unit, or the Limited Common Elements pertaining thereto, without the prior
<br />written consent thereto of the Board of Directors, which consent shall not be
<br />unreasonably withheld, conditioned or delayed. The Board of Directors shall have
<br />the obligation to answer any written request by a Unit Owner for approval of a
<br />proposed structural addition, alteration or improvement in such Unit Owner's Unit
<br />within thirty (30) days after such request, and failure to do so within the stipulated
<br />time shall constitute a consent by the Board of Directors to the proposed addition,
<br />alteration or improvement. Notwithstanding the foregoing, improvements of a
<br />cosmetic and decorative nature within a Unit and replacement of equipment and
<br />trade fixture within a Unit, which do not affect the structural integrity of any other
<br />Unit or inhibit the productive use of another Unit, shall be permitted without
<br />consent of the Board of Directors.
<br />2) Noxious or Offensive Trades Prohibited. No noxious or offensive trades,
<br />services, or activities shall be conducted within the Condominium or within any of
<br />the Units, nor shall anything be done thereon which may become an annoyance or
<br />nuisance to the Unit Owners of other Units within the Condominium; provided,
<br />however, this Article 12, Paragraph 2 shall in no way limit, prevent or prohibit the
<br />operation and ownership of a bar and restaurant (including, without limitation, the
<br />operation of keno and other games of chance) in Unit 101.
<br />3) Temporary, Modular and Storage Structures. Without approval from the Board of
<br />Directors: (i) no temporary structures, including but not limited to, trailers, mobile
<br />homes, converted trailers, or accessory buildings, shall be used on any Unit or
<br />Common Elements, and (ii) no modular constructed structures are allowed. No
<br />garages are allowed.
<br />4) Restriction on Food Trucks. Food trucks are not permitted on the Common
<br />Elements unless: (i) a majority of Unit Owner's (including, without limitation the
<br />consent of the Unit Owner of Unit 101) consent, (ii) for limited, non -recurring
<br />special events upon prior notice to all Unit Owners, or (iii) in connection with a
<br />once weekly farmer's market upon prior notice to all Unit Owners.
<br />5) Antennas and Satellite Dishes. Antennas are allowed if the Board of Directors
<br />determines they are not unsightly and approves the same. Satellite dishes are
<br />allowed, provided that the location and size thereof is approved by the Board of
<br />Directors and the satellite dish is mounted on the roof, out of sight from the street.
<br />6) Storage of Vehicles. Overnight storage of vehicles of any kind is not allowed.
<br />7) Maintenance of Units and Improvements. Each Unit Owner shall keep its Unit in
<br />good repair. Trash, garbage, and other solid, semi -solid, and liquid waste shall be
<br />kept within sealed containers, shall not be allowed to accumulate on any Unit, and
<br />shall be disposed of in a sanitary manner. All containers shall be kept in a neat,
<br />clean, and sanitary condition. No trash, litter or junk shall be permitted to remain
<br />exposed upon any Unit or visible from adjacent streets or other Units. Burning of
<br />trash on a Unit shall be prohibited. No lumber or other building materials shall be
<br />stored or permitted to remain on any Unit unless screened from view from other
<br />Units and except for reasonable storage during construction.
<br />8) Nuisance. Nothing shall be done or permitted on any Unit which is or may become
<br />a nuisance. No obnoxious or offensive activities shall be conducted on any Unit.
<br />Notwithstanding the foregoing, this Article 12, Paragraph 8 shall in no way limit,
<br />prevent or prohibit the operation and ownership of a bar and restaurant (including,
<br />without limitation, the operation of keno and other games of chance) in Unit 101.
<br />9) Damage or Destruction of Improvements. If any Unit or structure constructed on a
<br />Unit is damaged, either in whole or in part, by fire or other casualty, said structure
