202500670 <br />shall be rebuilt in a timely manner, not to exceed nine (9) months from the date of <br />damage; provided, however, if such structure cannot be rebuilt in said nine (9) <br />month period but construction has been commenced and continued in an orderly <br />manner, said nine (9) month period shall be extended as necessary to allow such <br />construction to be completed. <br />10) Signs. No sign of any character shall be displayed or placed upon any Unit without <br />approval from the Board of Directors, which approval shall not be unreasonably <br />withheld, conditioned or delayed. The Board of Directors shall have the obligation <br />to answer any written request by a Unit Owner for approval of a proposed sign <br />within thirty (30) days after such request, and failure to do so within the stipulated <br />time shall constitute a consent by the Board of Directors to the proposed sign. <br />11) Night Time Lighting. Units may be continuously illuminated during the period of <br />sunset to sunrise with lights as necessary for security and the operation of a bar and <br />restaurant in Unit 101. <br />12) Further Subdivision. Except as provided herein for Unit 102 and Unit 201, no Unit <br />may be further subdivided without the Approval of all Unit Owners. <br />13) Disturbing the Peace. No Person shall disturb, tend to disturb or aid in disturbing <br />the peace of others by violent, tumultuous, offensive, disorderly or obstreperous <br />conduct and no Unit Owner shall knowingly permit such conduct. <br />Notwithstanding the foregoing, this Article 12, Paragraph 13 shall in no way limit, <br />prevent or prohibit the operation and ownership of a bar and restaurant (including, <br />without limitation, the operation of keno and other games of chance) in Unit 101. <br />14) Drainage. No Unit Owner shall modify or change the topography or contour of any <br />drainage areas or easements, including swales, existing upon any portion of the <br />Condominium. <br />15) Parking, Parking shall be allowed in accordance with rules and regulations adopted <br />by the Board of Directors. The Board of Directors shall not have authority to adopt <br />any rule or regulation, or alter the designated parking lots in a manner which <br />reduces the amount of parking available to the Unit Owners for use by their guests, <br />invitees, patrons, and in the general operation of a Unit Owner's business to less <br />than sixty-seven (67). <br />16) General Prohibition. No use shall be made of a Unit Owner's Unit which will in any <br />manner violate the statutes, ordinances, rules and regulations of any governmental <br />authority having jurisdiction over the use of said Unit. <br />ARTICLE 13 <br />GENERAL PROVISIONS <br />1) Enforcement. The Association or any Unit Owner may enforce the restrictions, <br />conditions, covenants and reservations imposed by the provisions of any <br />Documents by proceedings at law or in equity, against any Person or against the <br />Association violating or attempting to violate any of the terms of the Documents, <br />either to recover damages for such violation, including reasonable attorneys' fees <br />incurred in enforcing this Declaration or the Documents, or to restrain such <br />violation or attempted violation or to modify or remove structures fully or partially <br />completed in violation thereof, or both. Failure of the Association or of any Unit <br />Owner to enforce any covenant or restriction contained in the Documents shall in <br />no event be deemed a waiver of the right to do so thereafter. The Association shall <br />not be liable to reimburse any Unit Owner for attorneys' fees or costs incurred in <br />any suit brought by a Unit Owner against anyone other than the Association to <br />enforce or attempt to enforce this Declaration or other Documents. <br />2) Term of Declaration. This Declaration shall run with the land, shall be binding upon <br />all Persons owning Units and any Persons hereafter acquiring said Units, and shall <br />be in effect in perpetuity unless amended or terminated as provided in the Act. <br />10 <br />
