Declarant is the owner of the real property legally described as follows: <br />Lot Two (2), Medical Park Subdivision, in the City of Grand Island, Hall <br />County, Nebraska. <br />2. Declarant hereby creates a Condominium on the Property pursuant to the Nebraska <br />Condominium Act, Neb. Rev. Stat. § 76-825, et seq., as amended from time to time (the <br />"Act"), in which portions of the Property are designated for separate ownership and the <br />remainder of which are designated for common ownership by GRAND ISLAND <br />MEDICAL PARK PROFESSIONAL BUILDING CONDOMINIUM ASSOCIATION, a <br />Nebraska nonprofit corporation (the "Association"). <br />3. Declarant has incorporated the Association for the purpose of exercising the <br />functions herein set forth. <br />ARTICLE 1. SUBMISSION OF PROPERTY <br />Declarant hereby publishes and declares that the Property shall be held, sold, <br />conveyed, transferred, leased, subleased and occupied subject to the following easements, <br />covenants, conditions, and restrictions which are for the purpose of protecting the value <br />and desirability of the Property, and which shall run with the Property and shall be binding <br />upon and inure to the benefit of all parties having any right, title, or interest in the Property, <br />or any portion thereof, their heirs, personal representatives, successors, and assigns. <br />Additionally, Declarant hereby submits the Property to the provisions of the Act. <br />ARTICLE 2. DEFINITIONS <br />1. General. The following terms used herein shall have the following meanings: <br />a) "Allocated Interests" means the undivided interest in the Common <br />Elements and the Common Expense Liability allocated to each Unit. <br />b) "Approval" or "Approved" shall mean securing the prior, written <br />approval as required herein before taking any action for which approval <br />is required. <br />1 <br />
