20250005 and that my spouse shall not be liable for waste or depreciation. My said spouse shall keep said property adequately insured, shall pay all insurance premiums, taxes and assessments, and shall maintain and keep the property in good condition and repair. My personal representative shall have no obligation with respect to said real estate and no responsibility to ascertain the performance of said duties by my said spouse. In the event my spouse at any time decides that he no longer desires to retain the life estate given to my spouse hereunder, my spouse may release such life estate by an instrument in writing duly acknowledged and delivered to the persons who will become entitled to such real estate under Paragraph B of this Article. B. Remainder Interest. Subject to the life estate given to my spouse in the preceding paragraph of this Article, or upon my death if my spouse does -not survive me, I give the remainder interest in the property described in this Article, in equal shares to my living children and the surviving issue of a deceased child of mine by right of representation, outright and free of trust, to be theirs absolutely and forever. ARTICLE VI Residuary Estate A. If my spouse survives me, I give and devise all of the rest, residue and remainder of my estate, whether now owned by me or hereafter acquired and wherever situated, to my spouse, outright and free of trust to have and to hold the same forever. B. If my spouse fails to survive me, I give and devise all of the rest, residue and remainder of my estate, both personal property and real estate, whether now owned by me or hereafter acquired and wherever situated, to my children, namely Gregory A. Krueger, William J. Krueger, Janet K. Wortman, and Debra D. Kawa, in equal shares, share and share alike; provided, however, that in the case of the death of any of my said children in my lifetime, leaving issue, I direct that the share of such deceased child shall not lapse, but shall pass to the issue of such deceased child by right of representation. ARTICLE VII Personal Representative I name, nominate and appoint my spouse, Arlon G. Krueger to be the Personal Representative of this, my Last Will and Testament. In the event of the resignation, refusal or inability of my spouse to so act as Personal Representative, then I name, nominate and appoint Gregory A. Krueger and William J.
