202500051 <br />that I may have under insurance policies relating thereto, to my spouse, <br />if my spouse survives me. Otherwise, if my spouse fails to survive, I <br />give such property in accordance with a memorandum which I intend to <br />leave at my death which I incorporate herein by this reference. If I do <br />not leave such a memorandum or if the same fails to dispose of all such <br />property effectively, then I direct that such property (all, or that not <br />disposed of effectively), be distributed in approximate equal shares to <br />my then living children to be divided as they shall agree. <br />ARTICLE V <br />Life Estate Bequest <br />A. Life Estate Interest. I hereby specifically give, devise, and <br />bequeath to my spouse, all of my interest in the following described real <br />estate, to wit: <br />The West Half of the Southwest Quarter (W1/2SW1/4), the <br />Southeast Quarter of the Southwest Quarter (SE1/4SW1/4) <br />and Lot Four (4), on Mainland in Section Twenty-eight <br />(28), and Lot One (1), on Mainland in Section Twenty- <br />nine (29), all in Township Ten (10) North, Range Nine <br />(9), West of the 6th P.M., Hall County, Nebraska, <br />to have and to hold said real estate above described during my spouse's <br />natural life. <br />I grant to my spouse during my spouse's lifetime the power to <br />sell this real estate in which my spouse has this life estate, at such <br />prices and upon such terms and in such manner, whether private or public <br />sale, as my spouse will deem to be prudent. Such power of sale shall <br />include the right to sell not only my spouse's interest in the real <br />estate, but also the interest of the remaindermen therein; Provided, <br />however, that such sale must require the consent or joinder of the <br />remaindermen. Any purchaser need not see to the proper application by <br />my spouse of the sale proceeds; however, the net proceeds, whether <br />reinvested in replacement real estate or invested in any other fashion, <br />shall be impressed with a similar life estate for the benefit and during <br />the remaining lifetime of my spouse, and with remainder interest as <br />provided hereinbelow in Paragraph B of this Article. I additionally <br />authorize and empower my spouse to lease or part of such real estate for <br />any period of time and although any such period may extend beyond my <br />spouse's life or beyond the date when my spouse may release such life <br />estate, without application to any court; and in connection with any such <br />lease to enter into any covenants or agreements relating to the property <br />so leased or to any improvements then or thereafter erected thereon. <br />I direct that my spouse shall be entitled to full possession <br />of the premises without the requirement of giving any bond or other <br />security in connection with the life estate given to my spouse hereunder <br />Page 2 of 5 <br />Certified Page 2 of 5 <br />
