202405035 <br />insurance coverage, the Decree shall become final and operative six months after the Decree is <br />entered. <br />II. CUSTODY AND VISITATION <br />A. CUSTODY: In consideration of the best interests of the children as required by <br />Nebraska law and specifically §42-364 and the provisions of the Parenting Act. The Court finds <br />that it is in the children's best interests that legal and physical custody be placed with the <br />Plaintiff. Given the difficulties the parties have in communicating and the need for stability of <br />the children (particularly Sam), the Court finds joint legal custody or a week -on week -off <br />schedule would not be appropriate. <br />B. VISITATION: The Defendant currently receives every other weekend visitation <br />with all three children and during weeks he does not receive weekend visitation he spends two <br />hours with Sam on Tuesdays and two hours with Nasya on Wednesdays. (Jaxson was not <br />included because of his age at the time of the temporary order.) <br />The Plaintiff presented evidence through Ms. Schwan, a therapist, that the weeknight <br />visitations were not appropriate for Sam because of his needs. Given the lack of any evidence <br />from the schools that the visitations were causing Sam increased behavioral problems or any <br />evidence concerning behavioral problems from a party other than the Plaintiff, the Court finds <br />Ms. Schwan's testimony unpersuasive. The Court further notes that the current visitation <br />schedule was crafted to allow the children time with their father to ensure that helping Sam <br />would not deprive the other children of attention during all other interactions with him. <br />The Court finds that it is in the best interests of the minor children that the Defendant <br />should have visitation with Sam from 5:30 p.m. to 7:00 p.m. on Tuesdays, Nasya from 5:30 p.m. <br />3'Page <br />Page �� <br />
