202405 035
The Plaintiff is to pay the Bank of America credit card account and her premarital debt to
Nelnet. The Defendant is to pay the IHG Visa and Sam's Mastercard account. The Court finds
that $929.69 of the Sam's Club Mastercard account is nonmarital debt.
Both parties request that the Court give them credit for funds expended during the
marriage. The Plaintiff for money spent from her inheritance and the Defendant for sums paid to
pay the Plaintiff's student loans. While there may be cases where the requested items could be
added or subtracted from the marital estate, this case is not one of them and in the Court's view
the items cancel each other.
The Plaintiff further requests that the Court consider recouping funds spent by the
Defendant on gambling and the $20,000 loan from his IRA account which was used to pay
gambling debts. The Court finds, as a matter of equity, the $20,000 loan ultimately deprived the
marital estate of $20,000 (by virtue of having to be repaid from the marital estate) and the Court
therefore considers the $20,000 as an asset of the Defendant.
The Court divides the marital estate as follows:
PROPERTY DIVISION
Assets
Plaintiff
Assets
Defendant
Real estate
$150,000.00
John Hancock IRA
$23,284.11
Personal Property
1,982.00
IRA Loan
20,000.00
Retirement
8,138.82
Jeep Laredo
6,896.00
Volvo
2,965.43
Jeep
1,000.00
Personal Property
1,000.00
Total Assets
$163,086.25
Total Assets
$51,880.11
9'Page
