200M255 <br />Hundredths (456.80) feet, to the northwest corner of Santa Anita Subdivision and to <br />a point on the west line of said Lot Two (2); thence deflecting right 89 033'42" and <br />running northerly along the west line of said Lot Two (2), a distance of Three <br />Hundred and Three Hundredths (300.03) feet, to the northwest corner of said Lot <br />Two (2); thence deflecting right 90 028'09" and running easterly along the north line <br />of said Lot Two (2), a distance of Four Hundred Fifty Six and Seventy Eight <br />Hundredths (456.78 feet, to the point of beginning. <br />3. Page 3 of the Former Second Subdivision Agreement placed a restriction on the <br />conveyance of Lot Two (2) of such subdivision until certain conditions were met pertaining to <br />ingress and egress to such lot. <br />4. Santa Anita Drive has since become a public, dedicated street with direct access for <br />ingress and egress into Lot Two (2), Fonner Second Subdivision. The need for the restriction of the <br />conveyance of Lot Two (2) of such subdivision as set out in the Fonner Second Subdivision <br />Agreement is no longer necessary. <br />5. The Fonner Second Subdivision Agreement shall be hereby amended to delete <br />Paragragh No. 5 on Page 3 of the Fonner Second Subdivision to remove any and all restrictions on <br />the conveyance of Lot Two (2), Former Second Subdivision. <br />6. The Subdivider shall dedicate a twenty (20.0) foot wide easement approximately <br />centered on the existing sanitary sewer service line in the eastern half of such property. Such <br />easement shall be recorded with the Hall County Register of Deeds contcmporaneously with this <br />amendment. <br />7. The Subdivider shall submit plans for driveway access from Lot Two (2) onto Santa <br />Anita Drive for approval by the City's Director of Public Works before construction of said <br />driveway. <br />-2- <br />
